PRIMEI DECIZIE DECIZIE Nr. 55718/08 Roberto MONTANARI și alții împotriva Italiei Curții Europene a Drepturilor Omului (prima secțiune), care așezează la 12 septembrie 2019 în calitate de comitet compus din: Aleš Pejchal, președinte, Jovan Ilievski, Raffaele Sabato, judecători și Liv Tigerstedt, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 11 noiembrie 2008, După deliberare, decide după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este prezentată în apendice. Reclamanții au fost reprezentați de dl F. Filippucci, un avocat care practică la Roma. Plăcerile reclamanților în temeiul articolului 1 din Protocolul nr. 1 la Convenție, privind calculul compensației de expropriare datorită acestora în conformitate cu art. 5 bis Legea nr. 359 din 1992 a fost comunicată guvernului italian („Guvernul”).

La 27 februarie 2019, Guvernul a prezentat observațiile lor cu privire la admisibilitatea și meritul cererii. La 8 mai 2019, reprezentantul reclamanților a informat Registrul că reclamanții au dorit să retragă cererea în fața Curții. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista de cazuri.

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix. The applicants were represented by Mr F. Filippucci, a lawyer practising in Rome. The applicants’ complaints under Article 1 of Protocol No. 1 to the Convention, concerning the calculation of the expropriation compensation due to them in accordance with Article 5 bis of Law No. 359 of 1992, were communicated to the Italian Government (“the Government”). On 27 February 2019 the Government submitted their observations on the admissibility and merits of the application. On 8 May 2019 the applicants’ representative informed the Registry that the applicants wished to withdraw the application before the Court.

THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
