Comunicat la 19 septembrie 2019 CUARTA SECȚIUNE Cererea nr. 65532/16 Jozsef KERTÉSZ împotriva Ungariei și a altor 3 cereri (a se vedea tabelul adăugat) OBIECTUL CAUZELOR Reclamanților se referă la condamnarea la închisoarea pe viață și la faptul că procedura lor obligatorie de iertare poate avea loc numai după ce au servit patruzeci de ani. Dl József Kertész a fost condamnat de Curtea de Apel Pécs la 10 ianuarie 2014. Dl László Tóth a fost condamnat de Curtea de Apel Debrecen la 20 mai 2015. Dl Mihály Nagy a fost condamnat de Curtea de Apel Budapesta la 28 februarie 2017. Dl Róbert Tóth a fost condamnat de Curtea de Apel Debrecen la 20 mai 2015. Reclamanții au fost privați de vreo perspectiva reală de eliberare și, astfel, potențial supuse pedepsei inumane, în încălcarea articolului 3 din Convenție, având în vedere faptul că nu vor fi eligibile pentru procedurile obligatorii de scutire înainte de a fi încheiat patruzeci de ani de închisoare (a se vedea T.P. și A.T. c. The applications concern the applicants’ conviction to life imprisonment and the fact that their mandatory pardon proceedings can take place only after having served forty years.

Mr József Kertész was convicted by the Pécs Court of Appeal on 10

January 2014.

Mr László Tóth was convicted by the Debrecen Court of Appeal on 20

May 2015.

Mr Mihály Nagy was convicted by the Budapest Court of Appeal on 28

February 2017.

Mr Róbert Tóth was convicted by the Debrecen Court of Appeal on 20

May 2015.
