DECIZIE A SEGUNDEI DECIZIE Nr. 21330/19 Fatma Betül ZEYBEK și alții împotriva Turciei Curții Europene a Drepturilor Omului (A doua secțiune), care așeză la 16 februarie 2021 în calitate de comitet compus din: Aleš Pejchal, Președintele Egidijus Kūris, Carlo Ranzoni, judecători și Hasan Bakırcı, secretar adjunct al secțiunii, având în vedere cererea depusă la 19 aprilie 2019, După deliberare, decide după cum urmează: FACTE ȘI PROCEDURĂ O listă a reclamanților este prezentată în apendice. Guvernul turc („Guvernul”) a fost reprezentat de agentul lor. Cererea se referă la presupusa dispariție a dlui Salim Zeybek, rudele reclamanților, după presupusa răpire de persoane necunoscute la 21 februarie 2019 și la presupusa lipsa unei anchete eficace asupra dispariției sale.
La 30 aprilie 2019, Curtea a hotărât să comunice guvernului plângerilor formulate în temeiul articolelor 2, 3 și 5 din convenție. La 31 octombrie 2020, reclamanții au informat Curtea că doresc să retragă cererea, deoarece dl Zeybek a fost găsit la 28 iulie 2019 și au declarat că nu a fost răpit, după cum se presupune. Curtea ia act de dorința exprimată de reclamanții de a retrage cererea. Având în vedere cele de mai sus și în absența unor circumstanțe speciale în ceea ce privește respectarea drepturilor garantate de Convenția sau de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenția, că nu mai este justificat continuarea examinării cererii. Având în vedere cele de mai sus, este necesar să se scoată cazul din listă.
Din aceste motive, Curtea, în unanimitate, hotărăște să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE
1. A list of the applicants is set out in the appendix.
The Turkish Government (“the Government”) were represented by their Agent.
The application concerned the alleged disappearance of Mr Salim Zeybek, the applicants’ relative, following his alleged abduction by unknown persons on 21 February 2019 and the alleged lack of an effective investigation into his disappearance.
On 30 April 2019 the Court decided to give notice to the Government of the applicants’ complaints raised under Articles 2, 3 and 5 of the Convention.
On 31 October 2020 the applicants informed the Court that they wanted to withdraw the application since Mr Zeybek was found on 28 July 2019 and stated that he had not been abducted, as alleged. THE LAW
The Court takes note of the wish expressed by the applicants to withdraw the application. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
