SEGUNDA SECȚIUNE DECIZIE Nr. 6228/18 Zekai BİLGİN împotriva Turciei și a altor 53 de cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A doua secțiune), care așezează la 17 mai 2022 ca comitet compus din: Egidijus Kūris, președinte, Pauliine Koskelo, Gilberto Felici, judecători și Hasan Bakırcı, grefierul secțiunii, având în vedere: Cerințele împotriva Turciei depuse Curții în temeiul articolului 34 din Convenția pentru protecția drepturilor omului și a libertăților fundamentale („Convenția”) de către reclamanții enumerați în tabelul anexat („Reclamanții”), la diferitele date indicate în acest articol; Decizia de a anunța cererea guvernului turc („ Guvernul”), reprezentată de agentul lor, dl Hacı Ali Açıkgül, șeful Departamentului Drepturilor Omului Ministerului Justiției; având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți; având în vedere deliberat, hotărăște după cum urmează: OBIECTUL CAUZEI Cerințele se referă la retragerea licențelor reclamanților pentru operarea liniilor de autobuz.

Faptele și plângerile sunt foarte similare cu cele din cazul Temizișler Madeni Yağ Sanayi Ticaret Limited Șirketi c. Turcia, (dec.) nr. 44159/18, 12 octombrie 2021). Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Reclamanții se plâng de încălcarea dreptului lor la bucurarea pașnică a bunurilor lor în sensul articolului 1 din Protocolul nr. 1 având în vedere retragerea licențelor lor de operare a liniilor de autobuz, susțin, de asemenea, că hotărârile interne ale instanței nu au avut suficiente motive și că nu au fost în măsură să participe la procedurile judiciare în încălcarea dreptului lor la un proces echitabil în temeiul articolului 6 din Convenție.

Curtea constată că, în hotărârea Temizișler Madeni Yağ Sanayi Ticaret Limited Șirketi (citată mai sus) , s-a constatat că societatea reclamantă nu putea fi conștientă de faptul că nu are dreptul de a se reînnoi dincolo de perioada de zece ani și că există un risc clar că contractul va expira la sfârșitul perioadei de zece ani prevăzute în lege, indiferent de intențiile autorităților municipale. În plus, Curtea a considerat că natura ilegală a reînnoirii de-a lungul acestei perioade era suficient de clară că, în ciuda comportamentului municipiului, retragerea licenței și lipsa compensației nu ar putea fi considerată ca alocată unei sarcini excesive individuale reclamantului.

În consecință, Curtea a hotărât că nici nerenovarea, nici absența compensației nu au afectat echilibrul echitabil care trebuie să existe între interesele diferitelor în joc în temeiul articolului 1 din Protocolul nr. 1 în ceea ce privește celelalte plângeri, având în vedere informațiile în posesia sa și în măsura în care are competența de a se pronunța asupra acuzațiilor formulate, Curtea nu a constatat nicio încălcare. În ceea ce privește circumstanțele prezentelor cauze și examinarea tuturor materialelor care i-au fost prezentate, Curtea nu a constatat niciun fapt sau argument capabil să-l convingă să ajungă la o concluzie diferită în ceea ce privește aceste cereri, rezultând că aceste cereri sunt vădit nefondate și trebuie respinse în conformitate cu art. 35 §§ § 3 litera (a) și 4 din Convenție.

Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declara cererile inadmisibile.

DECISION Application no. 6228/18 Zekai BİLGİN against Turkey and 53 other applications (see list appended) The European Court of Human Rights (Second Section), sitting on 17 May 2022 as a Committee composed of: Egidijus Kūris, President, Pauliine Koskelo, Gilberto Felici, judges, and Hasan Bakırcı, Section Registrar, Having regard to: The applications against Turkey lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by the applicants listed in the appended table (“the applicants”), on the various dates indicated therein; The decision to give notice of the application to the Turkish Government (“the Government”), represented by their Agent Mr Hacı Ali Açıkgül, Head of the Human Rights Department of the Ministry of Justice; Having regard to the observations submitted by the respondent Government and the observations in reply submitted by the applicants; Having deliberated, decides as follows:

SUBJECT MATTER OF THE CASE

1. The applications concern the withdrawal of the applicants’ licences to operate bus lines. The facts and complaints are very similar to those in the case of Temizișler Madeni Yağ Sanayi Ticaret Limited Șirketi v. Turkey , ((dec.) no. 44159/18, 12 October 2021).

THE COURT’S ASSESSMENT

2. Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

The applicants complain of an infringement of their right to peaceful enjoyment of their possessions within the meaning of Article 1 of Protocol No. 1 on account of the withdrawal of their licenses to operate bus lines. They also allege that the domestic court decisions lacked sufficient reasoning and that that they were unable to participate in the court proceedings in violation of their right to a fair trial under Article 6 of the Convention.

The Court notes that in the Temizișler Madeni Yağ Sanayi Ticaret Limited Șirketi decision (cited above) , it found that the applicant company could not be unaware of the fact that it did not have a right to renewal beyond the ten-year period and that there was a clear risk that the contract would expire at the end of the ten years’ period foreseen in the law, regardless of the intentions of the municipal authorities. The Court further considered that the illegal nature of a renewal beyond this period was sufficiently clear that, despite the municipality’s conduct, the withdrawal of the license and the lack of compensation could not be considered to have placed an individual excessive burden on the applicant. Accordingly, the Court ruled that neither the non-renewal nor the absence of compensation upset the fair balance which must exist between the various interests at stake under Article 1 of Protocol No. 1.

As to the other complaints, having regard to the information in its possession and in so far as it had jurisdiction to rule on the allegations made, the Court found no appearance of a violation.

Turning to the circumstances of the present cases and having examined all the material submitted to it, the Court has not found any fact or argument capable of persuading it to reach a different conclusion as regards these applications.

It follows that these applications are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 (a) and 4 of the Convention. For these reasons, the Court, unanimously, Decides to join the applications; Declares the applications inadmissible. Done in English and notified in writing on 9 June 2022.
