SEGUNDA SECȚIUNE CAUZĂ DE MEHMEDOVI ȘI ALȚII v. SERBIA (Aplicații nr. 23202/20 și 14 altele – a se vedea lista adăugată) JUDGMENT STRASBOURG 29 septembrie 2022 Această hotărâre este finală, dar poate fi supusă revizuirii editoriale. În cazul Mehmedović și alții c. Serbia, Curtea Europeană a Drepturilor Omului (A doua secțiune), ședința în calitate de comitet compus din: Jovan Ilievski , președinte, Gilberto Felici , Diana Sârcu , judecători și Viktoriya Maradudina , grefierul adjunct al secțiunii interioare , care a deliberat în privat la 8 septembrie 2022 , pronunță următoarea hotărâre , care a fost adoptată la data respectivă: PROCEDURA Cazul a fost originat în cererile împotriva Serbiei depuse la Curte în temeiul articolului 34 din Convenția pentru Protecția Drepturilor Omului și a Libertăților Fundamentale („Convenția”) privind diferitele date indicate în tabelul adăugat.
Reclamanții au fost reprezentați de R. Čakara, un avocat care practică în Novi Pazar. Guvernul sârb (“ Guvernul”) a primit avizul asupra cererilor la 20 mai 2021. FACTUL Lista reclamanților și detaliile relevante ale cererilor sunt prezentate în tabelul anexat. Reclamanții se plângeau de aplicarea întârzietă a deciziilor interne luate împotriva societăților sociale/de stat. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze împreună într-o singură hotărâre. Reclamanții s-au plâns de aplicarea întârziată a deciziilor interne în favoarea lor.
Ei au invocat, în mod expres sau în fond, la art. 6 § 1 din Convenție și la art. 1 din Protocolul nr. 1, care se citește după cum urmează: art. 6 § 1 „În determinarea drepturilor și obligațiilor sale civile ... fiecare are dreptul la o audiere echitabilă ... de [a] ... tribunal ...” art. 1 din Protocolul nr. 1 „Fiecare persoană fizică sau juridică are dreptul la bucuria pașnică a bunurilor sale. Nimeni nu poate fi privat de bunurile sale cu excepția interesului public și sub rezerva condițiilor prevăzute de lege și de principiile generale ale dreptului internațional.
Cu toate acestea, dispozițiile anterioare nu afectează în niciun fel dreptul unui stat de a aplica legile pe care le consideră necesare pentru a controla utilizarea bunurilor în conformitate cu dobânda generală sau pentru a asigura plata impozitelor sau a altor contribuții sau penalități.” Curtea reiterează că executarea unei hotărâri din partea oricărei instanțe trebuie considerată o parte integrantă a unei „audieri” în sensul articolului 6. Se referă, de asemenea, la jurisprudența sa privind neexecuția sau întârziarea executării hotărârilor interne finale (a se vedea Hornsby c. Grecia , nr. 18357/91, § 40, Raporturi de hotărâri și hotărâri 1997 II).
Prin urmare, Curtea consideră că deciziile din prezentele cereri au ordonat adoptarea unor măsuri specifice, în sensul articolului 1 din Protocolul nr. 10. În cazul principal al R. Kačapor și alții c. Serbia, nr. 2269/06 și altele 5 din 15 ianuarie 2008, Curtea a constatat deja o încălcare în ceea ce privește chestiuni similare cu cele din acest caz. 11. După examinarea tuturor materialelor prezentate, Curtea nu a constatat niciun fapt sau argument care să-l convingă să ajungă la o concluzie diferită cu privire la admisibilitatea și meritul acestor plângeri. Nikolić și alții c. Serbia (dec.) [Comitetul], nr. 48162/18 și altele 8, 21 ianuarie 2021. Obiecția Guvernului potrivit căreia cererile constituie un abuz al dreptului de cerere, deoarece reclamanții nu au informat Curtea că hotărârile interne în cauză au fost executate între timp, trebuie, prin urmare, respinse.
Având în vedere jurisprudența sa privind acest subiect, Curtea consideră că, în cazul instantaneu, autoritățile nu au desfășurat toate eforturile necesare pentru aplicarea în timp util a deciziilor interne în favoarea reclamanților. 12. Prin urmare, aceste plângeri sunt admisibile și dezvăluie o încălcare a art. 6 § 1 din Convenție și a art. 1 din Protocolul nr. APLICAREA ARTICOLULUI 41 AL CONVENȚIEI 13. art. 41 din Convenție prevede: „Dacă Curtea constată că a existat o încălcare a Convenției sau a Protocolelor sale, și în cazul în care dreptul intern al Înaltei Parte contractante în cauză permite numai repararea parțială, Curtea oferă, dacă este necesar, satisfacție echitabilă părții vătămate.” 14. Legea (a se vedea, în special, R. Kačapor și alții, citată mai sus, și Stanković c. Serbia (dec.), 41285/19, 19 decembrie 2019), Tribunalul consideră că este rezonabil atribuirea sumelor indicate în tabelul adăugat.
15. Curtea consideră, de asemenea, oportun ca rata dobânzii implicite să se bazeze pe rata marginală de creditare a Băncii Centrale Europene, la care ar trebui adăugate trei puncte procentuale.
Pentru aceste motive, CURTEA, UNANIMOUS, decide să se alăture cererilor; declara cererile admisibile; declară că aceste cereri declară o încălcare a articolului 6 § 1 din Convenția și art. 1 din Protocolul nr. 1 privind aplicarea întârziere a deciziilor interne adoptate împotriva societăților sociale/de stat; deține (a) că statul pârât trebuie să plătească reclamanților, în termen de trei luni, sumele indicate în tabelul adăugat, care urmează să fie convertite în moneda statului interesat la rata aplicabilă la data decontare; (b) care de la expirarea celor trei luni menționate mai sus până la decontarea dobânzilor simple se achită pe sumele de mai sus la o rată egală cu rata de creditare marginală a Băncii Centrale Europene în timpul perioadei de incumpărare plus trei puncte procentuale.

1.The case originated in applications against Serbia lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on the various dates indicated in the appended table.
2.The applicants were represented by R. Čakara, a lawyer practising in Novi Pazar.
3.The Serbian Government (“the Government”) were given notice of the applications on 20 May 2021. THE FACTS

5.The applicants complained of the delayed enforcement of domestic decisions given against socially/State-owned companies. THE LAW
6. Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single judgment.

7.The applicants complained of the delayed enforcement of domestic decisions given in their favour. They relied, expressly or in substance, on Article 6 § 1 of the Convention and on Article 1 of Protocol No. 1, which read as follows: Article 6 § 1 “In the determination of his civil rights and obligations ... everyone is entitled to a fair ... hearing ... by [a] ... tribunal ...” Article 1 of Protocol No. 1 “Every natural or legal person is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law. The preceding provisions shall not, however, in any way impair the right of a State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties.”
8.The Court reiterates that the execution of a judgment given by any court must be regarded as an integral part of a “hearing” for the purposes of Article 6. It also refers to its case-law concerning the non-enforcement or delayed enforcement of final domestic judgments (see Hornsby v. Greece , no. 18357/91, § 40, Reports of Judgments and Decisions 1997 ‑ II).
9.The Court further notes that the decisions in the present applications ordered specific action to be taken. The Court therefore considers that the decisions in question constitute “possessions” within the meaning of Article 1 of Protocol No. 1.
10.In the leading case of R. Kačapor and Others v. Serbia, nos. 2269/06 and 5 others, 15 January 2008, the Court already found a violation in respect of issues similar to those in the present case.
11.Having examined all the material submitted to it, the Court has not found any fact or argument capable of persuading it to reach a different conclusion on the admissibility and merits of these complaints. Notably, the Court notes that the domestic decisions in question were finally enforced after the communication of the applications to the Government (see the appended table; contrast Nikolić and Others v. Serbia (dec.) [Committee], nos. 48162/18 and 8 others, 21 January 2021). The Government’s objection that the applications constituted an abuse of the right of petition, because the applicants had failed to inform the Court that the domestic decisions in question had meanwhile been enforced, must therefore be dismissed. Having regard to its case-law on the subject, the Court considers that in the instant case the authorities did not deploy all necessary efforts to enforce in due time the domestic decisions in the applicants’ favour.
12.These complaints are therefore admissible and disclose a breach of Article 6 § 1 of the Convention and Article 1 of Protocol No. 1.
13. Article 41 of the Convention provides: “If the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.”
14.Regard being had to the documents in its possession and to its case ‑ law (see, in particular, R. Kačapor and Others, cited above, and Stanković v. Serbia (dec.), 41285/19, 19 December 2019), the Court considers it reasonable to award the sums indicated in the appended table.
15.The Court further considers it appropriate that the default interest rate should be based on the marginal lending rate of the European Central Bank, to which should be added three percentage points. FOR THESE REASONS, THE COURT, UNANIMOUSLY, Decides to join the applications; Declares the applications admissible; Holds that these applications disclose a breach of Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the delayed enforcement of domestic decisions given against socially/State-owned companies; Holds (a) that the respondent State is to pay the applicants, within three months, the amounts indicated in the appended table, to be converted into the currency of the respondent State at the rate applicable at the date of settlement; (b) that from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amounts at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.
