Resolution CM/ResDH(2010)150 [1] Execution of the judgment of the European Court of Human Rights in the case of Dura against Romania (Application No. 10793/02, judgment of 21June 2007, friendly settlement) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”); Having regard to the judgment in this case, transmitted by the Court to the Committee once it had become final; Recalling that the applicant’s complaint declared admissible in this case concerned the failure of the domestic authorities in their obligation to assist him in the enforcement of a final judicial decision ordering private parties to pay him certain amounts (complaint under Article 6, paragraph 1); Whereas in this case the Court, having taken formal note of friendly settlement reached by the government of the respondent state and the applicant’s heirs, who, after the applicant’s death on 26 December 2005, informed the Court that they intended to continue the proceedings before it,

Having satisfied itself that on 4 October 2007, thirteen days after the expiry of the time-limit set, the government of the respondent state paid the representative of the applicant’s heirs the sum provided in the friendly settlement and, having taken note of the fact that, in view of the minimal sum involved, the representative of the applicant’s heirs has waived their right to default interest, and that no other measure was required in this case to comply with the Court’s judgment; DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention with respect to the commitments subscribed to in this case and DECIDES to close its examination.
