Lugspetsvuglepostavka împotriva Ucrainei

A cincea secțiune DECIZIE Numărul de cerere 18257/09 de LUGSPETSVUGPOSTAVKA împotriva Ucrainei Curtea Europeană a Drepturilor Omului (a cincea secțiune), care a stat la 12 aprilie 2011 în calitate de comitet compus din: Boštjan M. Zupančič, președintele, Ganna Yudkivska, Angelika Nußberger, judecători și Stephen Phillips, grefierul adjunct al secțiunii, având în vedere cererea depusă la 2 martie 2009, după ce a deliberat, hotărăscește după cum urmează: FACTELE Solicitarea a fost depusă de Lugspetsvuglepostavka, o societate de răspundere limitată ucraineană cu sediul în Lugansk. Acesta a fost reprezentat în fața Curții de către dl O. Bilokon, un avocat practicant în Donetsk. Reclamantul s-a plâns de neexecutarea hotărârilor judecătorești în favoarea sa.

Prin scrisoarea din 27 octombrie 2010 avocatul reclamantului a solicitat Curtea să pună capăt examinării cererii. DREPTUL Având în vedere cele de mai sus și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția sau de Protocolurile sale, Curtea consideră că reclamantul nu dorește să continue cererea în sensul articolului 37 § 1 litera (a) din Convenție. Având în vedere cele de mai sus, este necesar să se scoată cazul din listă. Din aceste motive, Curtea decide în unanimitate să excludă cererea din lista de cazuri. Stephen Phillips Boštjan M. Zupančič, President, Ganna Yudkivska, Angelika Nußberger, judges, and Stephen Phillips, Deputy Section Registrar, Having regard to the above application lodged on 2 March 2009, Having deliberated, decides as follows: THE FACTS The application was lodged by Lugspetsvuglepostavka, a Ukrainian limited liability company based in Lugansk. It was represented before the Court by Mr O. P. Bilokon, a lawyer practising in Donetsk. The applicant complained about non-enforcement of court judgments in its favour. By letter dated 27 October 2010 the applicant’s lawyer requested the Court to terminate the examination of the application.

THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court considers that the applicant does not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court unanimously Decides to strike the application out of its list of cases.
