Rezoluția CM/ResDH(2012)156 [1] Ignatov, Gochev și Nalbantski împotriva Bulgariei Execuția hotărârilor Curții Europene a Drepturilor Omului (Recherche n 50/02, Hotărârea 02/07/2009, definitivă a 02/10/2009 Cerere n 3433/03, Hotărârea din 26/11/2009, definitivă la 26/03/2010 Cerere n 3094/04, Hotărârea din 10/02/2011, definitivă la 10/05/2011) Comitetul miniștrilor, în temeiul articolului 46 alineatul (2) din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale, care prevede că el supraveghează executarea hotărârilor definitive ale Curții Europene a Drepturilor Omului (denumite în continuare "menționate mai jos " Convenția" și "Curtea"), Având în vedere hotărârile definitive, care au fost transmise de Curte Comitetului în cauzele de mai sus și încălcările constatate (a se vedea documentul DH-DD(2012) 912E [2] prin care se reamintește obligația statului pârât, în temeiul articolului 46 alineatul (3) (1) din Convenție, să se conformeze hotărârilor definitive în litigiile la care este parte și că această obligație implică, pe lângă plata satisfacției echitabile acordate de Curte, adoptarea de către autoritățile din statul membru în cauză, dacă este necesar de măsuri individuale pentru a pune capăt încălcărilor constatate și pentru a elimina consecințele acestora, în măsura posibilului de către Restitutio in integrum ; și măsuri generale de prevenire a unor încălcări similare ; Am invitat guvernul statului pârât să informeze Comitetul cu privire la măsurile luate pentru a se conforma obligațiilor menționate anterior După ce a examinat bilanțul de acțiune furnizat de guvern care indică măsurile adoptate pentru a executa hotărârile, inclusiv informațiile furnizate în ceea ce privește plata satisfacției echitabile acordate de Curte (a se vedea documentul DH-DD(2012) 912E) ; cu asigurarea faptului că au fost adoptate toate măsurile impuse de art. 46 alineatul (1) DECLAMENTUL PE CARE își îndeplinește funcțiile în temeiul articolului 46 alineatul (2) din Convenția în aceste cazuri și DECIDE d'en . Acțiunea reportează 3 căsuțe against Bulgaria uiing freedom of movement Ignatov, aplicația nr. 50/02, judgment of 02/07/2009, final on 02/10/2009 Gochev, aplicația nr. 34383/03, judgment of 26/11/2009, final on 26/10/2010 Nalbantski, application no. 3094/04, judgment of 10/02/2011, final on 10/05/2011 1) DESCRIEREA OF THE CASES The three above privibles of the applicants appledom to leave the territory of Bulgaria impuned on different legal grounds. In the cases of Ignatov and Gochev the applicants were barted from leaving the country on the ground that they had failed to pay debts towards privatate persons. In the case of Ignatov the impugned measure was in force from 1999 to 2001 and was maintained dring that period even though the appicants debt had been settled and the trasvel ban had aparently lost its documentation. In the case of Gochev the ban to leave the country was in force from 2001 to 2008. It had been impozited automatically and without an individual evaluation of the aplicant 4 (freedom of movement) due to the authorities ui failure to ensure that any interference with an inqualels right to leave his or her country is, from the outset and throughout its duration, justited and proportionate in the light of the circumstances. In the case of Ignatov the Court found in addition of Article 13 (right to efectiv remedy), noting, in particular that the aplicant had not been pott to challenge the measure taken against him as had never been duly informad of it. The case of Nalbantski relative an automatic ban on the applicant mais leaving the country on the ground that he had a criminal comision and had not yet been rehabitated. The ban was impuned in 2004 and rmained in force until an unspecificed date, but not later than 2010 when legislative amendments put an end to the situation (see below). The European Court a found a violation of Article 2 of Protocol No. 4 because the domestic authorities had not analyzed the individual situation of the aplicant and had not provided sucient justice for the measure. It held that the mamafact that an individual has been criminalally convicted and has not yet been reabilitated canot justificy the impozit of restriction on his or her freedom to leave his or her country. În plus, in this case the Court found viols of Article 6 § 1 and 13, considerring that the length of the criminal procesedings against the aplicant had been excesiv and that he had had no efectiv remedies in that remedies. 2) INDIVIDUAL MEASures In alls the travel bans have been lifted. The criminal procededings in the case of Nalbantski ended in 2004. The European Court awarded the applicants moraly damage for the suffering and distress they experienced. The Government has paid the sums awarded. The Government thus considers that no further individual measures are necessary in the case. 3) GENERAL MEASSES As ass the general measures in these cases, the Government puncts out to the folowing developments: (a) rubrica of Ignatov and Gochev In aceste cases the travel bans were based on the International Passports Act, now repealed, and after that on the Bulgarian Personal Documents Act of 1998. At the time, the Bulgarian Personal Documents Act provided that the Ministry of the Interior could impune a prohibition on leaving the country on any individual who had debts established by judicial means, exceeding BGN 5000, towards other fizical or legal persons. In 2009 that provision (Namely, sectiune 75(6) of the Act) was amended to provide that the Ministry of the Interior was obligad to impune a prohibition on leaving the country on any individual who owed În 2011, "Ombudsman Challenged the Providence of section 75-[6) of the Bulgarian Personal Documents Act before the Constitutional Court, which, in a judgment of 31/03/2011, declarad that provision un constitutional. It found that the provision purpled a legitimate aim, namely the protection of the rights of others and of constitutional principles, but was prosed in a manner which was too wide, as it failed to diferenceish between debtors who had acted in bad fach and could be influenced by such a measure and bona fide debtors. In the latter case a travel ban would only be of a punctive character and could even hamper the colection of the debt. In addition, the Constitutional Court referred to the Providence of Article 2 of Protocol No. 4 and to the Gochev judgment discussed here. Under Bulgarian law once the Constitutional Court hs declarad a legal provision un constitutional, it is not to be applicated anymore. Thus, there is currently no legal ground for imposing measures such as the ones in the Ignatov and Gochev cases. (b) the case of Nalbantski In that case the travel ban was based on section 76(2) of the Bulgarian Personal Documents Act, which, at the time, provided that a person who had been convicted of a willful offence and had not been rehabitated could be barted from leaving the country and his international passport could be taken away. On 01/10/2009 that provision was repealed as it was considered to run counter to regulations of the European Union. A tranzitional support which entered into force on 10/04/2010 specificad that within three months of its entry all requirements measures previously impuned under section 76(2) would cease to have effect. Thas, the Government is of the view that reason for the violation found by the Court in the present case has been removed and that no viitor similar încălcări este posibil. As to the violation of the applicicants rights under Article 6 § 1 and 13, quinging the length of the criminal procesing against him, the Government notes that its its fors to resoluve these problems are being examined by the Committee of Ministers in the framework of the group of Kitov and the pilot judgment in the Dimitrov and Hamanov case and that the present case raises no separate issued. c) Concluzie On the bazis of the considerations above the Government is of the view that no further general measures are necessary in these cases.
