Publicat la 8 iulie 2024 SECȚIUNEA TERZĂ Cererea nr. 26424/23 Tessel HOFSTEDE împotriva Țărilor de Jos și a altor 3 cereri (a se vedea lista adăugată) comunicată la 21 iunie 2024 OBIECTUL CAUZEI Cerințele se referă la interzicerea suprafeței impuse reclamanților printr-un ordin de comportament penal (gedragsaanwijzing ), în contextul procedurilor penale în curs împotriva acestora. Reclamanții sunt reprezentanți ai Rebellionului Extinction (XR), o mișcare activistă internațională care organizează tot felul de proteste pentru a convinge guvernele să acționeze asupra schimbărilor climatice. Ei au fost suspectați că au comis, de mai multe ori, infracțiunea de a incita în mod deliberat la prezența și a participa la blocarea unei autostrăzi, perturbând grav ordinea publică.

Ca urmare a măsurilor impuse, reclamanții au fost împiedicați să participe la protestarea pe autostrada A12 organizată de XR la 28 ianuarie 2023. Reclamanții se plâng că ordinele de comportament penal au încălcat dreptul lor la adunarea și expresia pașnică, astfel cum sunt protejate în temeiul articolelor 11 și 10 din Convenție. În sensul articolului 11 § 1 din Convenție a existat o interferență cu libertatea de adunare pașnică a reclamanților (a se vedea Schwabe și M.G. c. Germania , nr. 8080/08 și 8577/08 , § 99-101, CEDH 2011 (extracții)? Dacă a fost așa, interferența prescrisă de lege, a servit un obiectiv legitim și a fost necesar într-o societate democratică în ceea ce privește 11 2 din Convenția (a se vedea).

SUBJECT MATTER OF THE CASE

The applications concern an area ban, imposed on the applicants through a criminal behaviour order ( gedragsaanwijzing ), in the context of ongoing criminal proceedings against them. The applicants are representatives of Extinction Rebellion (XR), an international activist movement organising all kinds of protests to persuade governments to act on climate change. They were suspected of having committed, several times, the criminal offence of deliberately inciting attendance of, and taking part in the blockade of a highway, thereby seriously disrupting public order. As a consequence of the measures imposed, the applicants were prevented from participating in the protest on the A12 highway organised by XR on 28 January 2023. The applicants complain that the criminal behaviour orders violated their right to peaceful assembly and expression as protected under Articles 11 and 10 of the Convention.

QUESTION TO THE PARTIES

Has there been an interference with the applicants’ freedom of peaceful assembly, within the meaning of Article 11 § 1 of the Convention (see Schwabe and M.G. v. Germany , nos. 8080/08 and 8577/08, § 99-101, ECHR 2011 (extracts)? If so, was that interference prescribed by law, did it serve a legitimate aim, and was it necessary in a democratic society in terms of 11 § 2 of the Convention (see Kudrevičius and Others v. Lithuania, [GC], no. 37553/05, §§ 109-110 and 140-160)?
