Çakir și alții împotriva Turciei

SEGUNDA DECIZIE DECIZIE Nr. 51274/07 Saime ÇAKIR împotriva Turciei și alte 100 de cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A doua secțiune), care așezează la 25 iunie 2013 în calitate de Cameră compusă din: Guido Raimondi, Președinte, Danutė Jočienė, Peer Lorenzen, András Sajó, Ișıl Karakaș, Nebojša Vučinić, Helen Keller, judecători și Stanley Naismith, grefierul secțiunii, Având în vedere cererile de mai sus, enumerate în apendice, după deliberare, hotărăște după cum urmează: FACTE O listă a reclamanților este prezentată în apendice. În plus, numărul de caz și numărul de decizie al procedurii impugate apar în apendice. Circumstanțele cazului Faptele cazului, astfel cum sunt prezentate de solicitanți, pot fi rezumate după cum urmează.

În diferite date, reclamanții au inițiat acțiuni în fața instanțelor civile sau a procedurilor au fost îndreptate împotriva lor în fața instanțelor civile sau penale. Procedurile au durat mai multe ani. Legea internă relevantă O descriere a dreptului intern relevant poate fi găsită în Müdür Turgut și alții (dec.), nr. 4860/09, §§§ 19-26, 26 martie 2013 COMPLAINTS Reclamanții au plâns în temeiul articolului 6 § 1 din Convenție că procedurile în fața instanțelor naționale nu au fost încheiate într-un timp rezonabil. Unele reclamanți au susținut, de asemenea, încălcări ale articolului 13 din Convenție și a articolului 1 din Protocolul nr. 1 la Convenție. În primul rând, Curtea consideră că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile ar trebui să fie însoțite, având în vedere contextul lor juridic comun.

Alegate încălcarea articolului 6 § 1 din Convenție Reclamanții se plângea că durata procedurii era incompatibilă cu cerințele de „tempă rațională”, prevăzute la articolul § 1 din Convenție, care se menționează după cum urmează: “În determinarea drepturilor și obligațiilor sale civile sau a oricărei acuzații penale împotriva lui, toți au dreptul la o ... audiție într-un timp rezonabil de către un ... tribunal ...” Curtea constată că reclamanții au afirmat că durata procedurii era incompatibilă cu principiul cerinței de „tempo rațional” în conformitate cu art. 6 § 1 din Convenție.

Curtea a constatat în Müdür Turgut și alții ((dec.), citată mai sus, § § § 58 și 60, că Comisia de compensare instituită prin Legea nr. 6384, în măsura în care este a priori accesibil și capabil de a oferi perspective rezonabile de remediere pentru plângeri privind durata procedurii, a constituit un remediu pe care reclamanții au fost obligați să-l epuizeze în sensul articolului 35 § 1 din Convenție. În prezent, Curtea nu vede motive de a ajunge la o concluzie diferită. În consecință, aceste plângeri trebuie respinse în temeiul articolului 35 § § § 1 și 4 din Convenția pentru neepuizarea recoursurilor interne.

„Toată persoana a căror drepturi și libertăți sunt încălcate în prezenta convenție are un remediu eficace în fața unei autorități naționale, în ciuda faptului că încălcarea a fost comisă de persoane care acționează în calitate oficială.” Curtea reamintește că, de asemenea, a susținut că Comisia de Compensare instituită prin Legea nr. 6384 prevede un remediu pentru reclamanții în sensul articolului 13 din Convenție pentru a se plânge cu privire la durata procedurilor în sensul articolului 6 § 1 din Convenție, referitor la toate cererile pendente în fața Curții depuse înainte de 23 septembrie 2012, și care nu au fost încă comunicate guvernului contestat (Müdür Turgut și alții (dec.), citate mai sus, § 59). Rezultă că aceste părți ale cererilor sunt în mod evident nefondate și trebuie respinse în conformitate cu art. 35 § § 3 și 4 din Convenție.

După examinarea atentă a plângerilor reclamanților în funcție de tot materialul în posesia sa, și în măsura în care chestiunea reclamată este de competența sa, Curtea constată că nu dezvăluie nicio apariție a unei încălcări a drepturilor și libertăților prevăzute în Convenția sau în Protocolurile sale. Rezultă că aceste părți ale cererilor sunt manifeste nefondate și trebuie respinse în conformitate cu art. 35 § § 3 și 4 din Convenție. Din aceste motive, Curtea decide în unanimitate să se alăture cererilor; declara cererile inadmisibile.

Additionally, the case and decision numbers of the impugned proceedings appear in the Appendix. A. The circumstances of the case The facts of the case, as submitted by the applicants, may be summarised as follows.

On various dates, the applicants initiated actions before the civil courts or proceedings were brought against them before the civil or criminal courts. The procedures lasted several years. B. Relevant domestic law A description of the relevant domestic law may be found in Müdür Turgut and Others ((dec.), no 4860/09, §§ 19-26, 26 March 2013 ). COMPLAINTS The applicants complained under Article 6 § 1 of the Convention that the proceedings before the national courts had not been concluded within a reasonable time. Certain applicants also alleged violations of Article 13 of the Convention and Article 1 of Protocol No. 1 to the Convention. THE LAW A. Joinder of the applications The Court first considers that in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given their common legal background.

B. Alleged violation of Article 6 § 1 of the Convention The applicants complained that the length of the proceedings had been incompatible with the “reasonable time” requirement, laid down in Article 6 § 1 of the Convention, which reads as follows: “In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a ... hearing within a reasonable time by a ... tribunal...” The Court observes that the applicants asserted that the length of the proceedings had been incompatible with the principle of the “reasonable time” requirement in accordance with Article 6 § 1 of the Convention.

The Court found in Müdür Turgut and Others ((dec.), cited above, §§ 58 and 60) that the Compensation Commission established by Law no. 6384, insofar as it is a priori accessible and capable of offering reasonable prospects of redress for complaints concerning the length of proceedings, constituted a remedy which applicants were required to exhaust for the purposes of Article 35 § 1 of the Convention. In the present cases the Court sees no reasons to come to a different conclusion. It follows that these complaints must be rejected under Article 35 §§ 1 and 4 of the Convention for non-exhaustion of domestic remedies. C. Alleged violation of Article 13 of the Convention Some applicants also complained that there had been no effective remedy under Turkish law.

They rely in this regard to Article 13 of the Convention, which provides: “Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity.” The Court recalls that it has also held that the Compensation Commission established by Law no. 6384 provides for a remedy to the applicants within the meaning of Article 13 of the Convention to complain about the length of proceedings for the purposes of Article 6 § 1 of the Convention, relating to all applications pending before the Court submitted before 23 September 2012, and not yet communicated to the respondent Government ( Müdür Turgut and Others (dec.), cited above, § 59). It follows that these parts of the applications are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention.

D. Alleged violation of Article 1 of Protocol No. 1 to the Convention Having carefully examined the applicants’ complaints in the light of all the material in its possession, and in so far as the matter complained of is within its competence, the Court finds that it does not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols. It follows that these parts of the applications are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention. For these reasons, the Court unanimously Decides to join the applications; Declares the applications inadmissible.
