A cincea secțiune DECIZIE Nr. 7044/23 Vitalius Vitautovich KUZMINSKAS împotriva Ucrainei Curții Europene a Drepturilor Omului (A cincea secțiune), care așezează la 17 octombrie 2024 în calitate de comitet compus din: Kateřina Šimáčková , Președintele Mykola Gnatovskyy, Artūrs Kučs , judecători și Viktoriya Maradodina, grefier interimar, având în vedere cererea depusă la 14 ianuarie 2023, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl. Vitaius Vitautovich Kuzminskas s-a născut în 1981. El a fost reprezentat de Dl. S. M. Rybiy, avocat practicant în Dnipro. La 5 au fost comunicate reclamațiile reclamantului în temeiul articolelor 3 și 13 din Convenția privind condițiile inadecvate ale detenției sale (“Guvernul”).

Octombrie 2023, reprezentantul reclamantului a informat Registrul că reclamantul nu mai a fost interesat să urmărească cererea în fața Curții și a vrut să o retragă. HOTĂRÂREA Având în vedere cele de mai sus, Curtea concluzionează că reclamantul poate fi considerat că nu mai dorește să urmărească cererea (articolul (a) din Convenție). În plus, în conformitate cu articolul Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererii. Prin urmare, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să excludă aplicarea din lista sa de cazuri.

FACTS AND PROCEDURE

The applicant, Mr Vitalius Vitautovich Kuzminskas, was born in 1981. He was represented by Mr S. M. Rybiy, a lawyer practising in Dnipro. The applicant’s complaints under Articles 3 and 13 of the Convention concerning the inadequate conditions of his detention were communicated to the Ukrainian Government (“the Government”). On 5 October 2023 the applicant’s representative informed the Registry that the applicant was no longer interested in pursuing the application before the Court and wanted to withdraw it. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 14 November 2024. Viktoriya Maradudina Kateřina Šimáčková Acting Deputy Registrar President
