Guvernul rus („Guvernul”) a fost reprezentat de dl G. Matyushkin, reprezentant al Federației Ruse la Curtea Europeană a Drepturilor Omului. Reclamanții Doamna Iokar, d-le Novikov și Ignatyev s-au plâns în temeiul articolului 6 din Convenție cu privire la absența lor de la procedura civilă la care au fost părți.
Dl Khimiy s-a plâns în temeiul articolului 6 din Convenție cu privire la absența sa de la procedura penală împotriva lui. Reclamațiile reclamanților au fost comunicate guvernului, care și-a prezentat observațiile cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamanților, care au fost invitați să își prezinte propriile observații. Niciun răspuns nu a fost primit la scrisorile Registrului. Prin scrisorile din 25 martie 2015, trimise prin post înregistrat, reclamanții au fost notificați că perioada autorizată pentru prezentarea observațiilor lor a expirat și că nu au fost solicitate prelungirea termenului. art. 37 § 1 litera (a) din Convenție, care prevede că Curtea poate ataca un caz din lista sa de cazuri în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea.
Cu toate acestea, nu a fost primit niciun răspuns de la niciunul dintre solicitanți. Curtea consideră că, în aceste circumstanțe, reclamanții pot fi considerați ca nu mai doresc să își urmărească cererile, în sensul articolului 37 alineatul (1) litera (a) din Convenție. În plus, în conformitate cu art. 37 alineatul (1) în amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cazurilor. Având în vedere cele de mai sus, este oportun să se scoată din listă cazurile. Din aceste motive, Curtea decide, în unanimitate, să se alăture cererilor, decide să se excludă cererile din lista de cazuri.

DECISION Application no. 4100/08 Roman Vasilyevich KHIMIY against Russia and 3 other applications (see list appended) The European Court of Human Rights (First Section), sitting on 22 September 2015 as a Committee composed of: Khanlar Hajiyev, President, Linos-Alexandre Sicilianos, Dmitry Dedov, judges, and André Wampach, Deputy Section Registrar, Having regard to the above applications lodged on 22 October 2007, Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. A list of the applicants is set out in the appendix.
The Russian Government (“the Government”) were represented by Mr G. Matyushkin, Representative of the Russian Federation at the European Court of Human Rights.
The applicants Ms Iokar, Messrs Novikov and Ignatyev complained under Article 6 of the Convention about their absence from civil proceedings to which they were parties. Mr Khimiy complained under Article 6 of the Convention about his absence from criminal proceedings against him.
The applicants’ complaints were communicated to the Government, who submitted their observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations. No reply was received to the Registry’s letters.
By letters dated 25 March 2015, sent by registered post, the applicants were notified that the period allowed for submission of their observations had expired and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike a case out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. However, no response has been received from either of the applicants. THE LAW
The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their applications, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the cases.
In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications, Decides to strike the applications out of its list of cases. Done in English and notified in writing on 15 October 2015.
