DECIZIE Nr. 58268/10 Arzu YILDIRIM și alții împotriva Turciei și alte două cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A doua secțiune), ședința la 8 decembrie 2015 în calitate de comitet compus din: Paul Lemmens, președinte, Ksenija Turković, Jon Fridrik Kjølbro, judecători și Abel Campos, grefier adjunct al secțiunii; Având în vedere cererile depuse de mai sus la datele indicate în apendice, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazurilor, după deliberare, hotărăsc după cum urmează: FACTE ȘI PROCEDURĂ O listă a reclamanților este prezentată în apendice. Toate acestea au fost reprezentate de dl M. İriz, un avocat practicant în İstanbul.
Guvernul turc („Guvernul”) au fost reprezentate de agentul lor. În baza articolelor 6, 11 și 13 din Convenție, reclamanții au susținut că au primit o penalizare disciplinară pentru participarea la o demonstrație și s-au plâns în continuare de lipsa unui remediu intern pentru a contesta măsurile disciplinare impugnate. La 5 august 2015 și 17 august 2015, Curtea a primit declarații de soluționare prietenoase semnate de părțile în temeiul cărora reclamanții au convenit să renunțe la orice nouă reclamație împotriva Turciei în ceea ce privește faptele care dau naștere la aceste cereri împotriva unei întreprinderi de a plăti exgrație de către Guvern pentru fiecare dintre ele 500 euro (EUR) pentru a acoperi prejudiciu material și moral și 5 300 EUR pentru costuri și cheltuieli, care vor fi convertite în moneda națională a statului défender la rata aplicabilă la data plății și vor fi eliberate de orice impozite care ar putea fi aplicabile.
Acesta va fi plătit în termen de trei luni de la data notificării deciziei luate de Curte. În cazul în care nu s-a plătit această sumă în termenul de trei luni, guvernul s-a angajat să plătească dobânzi simple pe aceasta, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de împrumut a Băncii Centrale Europene în timpul perioadei de incumprire plus trei puncte procentuale. Plata va constitui rezoluția finală a cazurilor. Având în vedere că cererile în cauză se referă la aceleași fapte și plângeri și pun probleme identice în temeiul Convenției, Curtea decide să se alăture acestora, în conformitate cu art. 42 § 1 din Regulamentul Curții. Curtea ia act de soluționarea prietenoasă atinsă între părți.
Este convins că soluționarea se bazează pe respectul drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, și nu găsește motive pentru a justifica o examinare continuă a cererilor. Având în vedere cele de mai sus, este necesar să se scoată cazurile din listă. Din aceste motive, Curtea, în unanimitate, Decide să se alăture cererilor; decide să scoată cererile din lista sa de cazuri în conformitate cu art. 39 din Convenție.

DECISION Application no. 58268/10 Arzu YILDIRIM and Others against Turkey and 2 other applications (see list appended) The European Court of Human Rights (Second Section), sitting on 8 December 2015 as a Committee composed of: Paul Lemmens, President, Ksenija Turković, Jon Fridrik Kjølbro, judges, and Abel Campos, Deputy Section Registrar, Having regard to the above applications lodged on the dates indicated in the appendix, Having regard to the formal declarations accepting a friendly settlement of the cases, Having deliberated, decides as follows:
A list of the applicants is set out in the appendix. They were all represented by Mr M. İriz, a lawyer practising in İstanbul. The Turkish Government (“the Government”) were represented by their Agent. Relying on Articles 6, 11 and 13 of the Convention, the applicants alleged that they were given a disciplinary penalty for taking part in a demonstration and complained further of a lack of a domestic remedy to challenge the impugned disciplinary measures.
On 5 August 2015 and 17 August 2015 the Court received friendly settlement declarations signed by the parties under which the applicants agreed to waive any further claims against Turkey in respect of the facts giving rise to these applications against an undertaking by the Government to pay ex gratia to each of them 500 euros (EUR) to cover pecuniary and non-pecuniary damage and EUR 5,300 for costs and expenses, which will be converted into the national currency of the respondent State at the rate applicable on the date of payment, and will be free of any taxes that may be applicable. It will be payable within three months from the date of notification of the decision taken by the Court.
In the event of failure to pay this sum within the said three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The payment will constitute the final resolution of the cases. THE LAW Given that the applications at hand concern the same facts and complaints and raise identical issues under the Convention, the Court decides to join them, pursuant to Rule 42 § 1 of the Rules of the Court. The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications.
In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.
