Rezoluția CM/ResDH(2016)30 Execuția hotărârii Curții Europene a Drepturilor Omului Emanuel și Rita Portelli împotriva Rezoluției Malta nr. Cazul de la decizia 55970/13 Emanuel și Rita PORTELLI 20/10/2015 (Adoptat de Comitetul de Miniștri la 8 martie 2016 la a 1250-a ședință a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere că, în acest caz, Curtea, după a luat notă oficială de soluționarea amicală atinsă de Guvernul Statului pârât și de reclamant, și după ce s-a constatat că soluționarea a fost bazată pe respectarea drepturilor omului astfel cum este definită în convenția sau în protocolul său, a decis să ia în considerare acest caz din lista sarcina sa; având însemnat că termenul de încheiat de încheiat amicul guvernul statului, DECLARESă, DECLARES că acesta a exercită și a exercită să exercită funcția sa de a exercită în temeiul articolului 39, în temeiul articolului 4 al Convenției de la Convenției.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
