CUARTA DECIZIE A SECȚIUNEI 20424/10 L. G. și alții împotriva Ungariei Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 4 septembrie 2018 în calitate de comitet compus din: Georges Ravarani, președinte, Marko Bošnjak, Péter Paczolay, judecători și Andrea Tamietti, grefierul adjunct al secțiunii, având în vedere cererea depusă la 22 martie 2010, Având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazului, după deliberare, hotărăsc după cum urmează: FACTE ȘI PROCEDIU Guvernul maghiar („Guvernul”) a fost reprezentat de dl Z. Tallódi, Agent al Ministerului Justiției. Reclamanții se plângeau în temeiul articolului 11 din Convenție cu privire la dispersarea demonstrației lor de către poliție.
Reclamanții au fost inițial reprezentați de dl L. Grespik. La 4 mai 2017, dl T. Gaudi-Nagy, un avocat practicant la Budapesta, a informat Curții cu privire la moartea dlui Grespik și a prezentat competențe de avocat de la doi dintre solicitanți. La 2 iunie 2017, Curtea a invitat Guvernul să prezinte observații cu privire la admisibilitatea și meritul plângerii reclamanților. Prin scrisoarea din 13 iunie 2017, dl Gaudi-Nagy a fost informat cu privire la comunicarea cauzei și invitat să prezinte competențe de procuror emanate de toate reclamanții. La 6 aprilie 2018, 120 din 173 solicitanți au prezentat competențe de procuror, autorizand dl. Gaudi-Nagy să acționeze în numele lor și să le reprezinte în fața Curții.
Restul cincizeci și trei de solicitanți nu au prezentat nici un drept de procuror pentru dl Gaudi-Nagy sau orice altă persoană. Resoluție prietenoasă atinsă în ceea ce privește 120 de solicitanți O listă a 120 de solicitanți în cauză este prevăzută în apendicele A. La 16 mai și 22 mai 2018, Curtea a primit declarații de decontare prietenoase semnate de 120 de solicitanți și de Guvern în temeiul cărora reclamanții au convenit să renunțe la orice alte cereri împotriva Ungariei în ceea ce privește faptele care dau naștere la această cerere împotriva unei întreprinderi ale Guvernului de a le plăti 862 EUR (opt sute șaizeci și două de euro) fiecare pentru a acoperi orice prejudiciu material și moral, precum și costurile și cheltuielile, care vor fi convertite în moneda statului contestat la rata aplicabilă la data plății, și vor fi libere de orice impozite care pot fi aplicabile.
Acesta va fi plătit în termen de trei luni de la data notificării hotărârii luate de Curte. În cazul în care nu s-a plătit această sumă în termenul de trei luni, guvernul s-a angajat să plătească dobânzi simple pe aceasta, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de împrumut a Băncii Centrale Europene în timpul perioadei de incumprire plus trei puncte procentuale. Plata va constitui rezoluția finală a cazului. O listă a celor cincizeci și trei de solicitanți rămasi este stabilită în apendicele B. Aceste solicitanți nu au abordat Curtea începând cu 21 martie 2016, data ultimei scrisori de la dl Grespik. După decesul reprezentantului acestora, aceste solicitanți nu au prezentat un drept de avocat care autorizează reprezentarea lor în fața Curții.
În plus, dl Gaudi Nagy, noul reprezentant al 120 de reclamanți, a informat Curtea că a încercat să contacteze cele 53 de solicitanți la adresele înregistrate la dl Grespik și la cele rezultate din registrul oficial. Totuși, încercările sale nu au reușit. În ceea ce privește cele 120 de solicitanți enumerate în apendicele A, Curtea ia act de soluționarea prietenoasă achiziționată între ei și guvernul (a se vedea punctul 7 de mai sus). Este convins că soluționarea se bazează pe respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, și nu găsește motive pentru a justifica o examinare continuă a cererii. Prin urmare, această parte a cererii ar trebui eliminată din lista cazurilor în conformitate cu art. 39 din Convenție.
11. În ceea ce privește restul de cincizeci și trei de solicitanți enumerați în apendicele B, faptul că nu au fost informați Curții cu privire la un nou reprezentant sau, într-adevăr, la comunicarea cu Curtea sau cu reprezentantul desemnat de alte solicitanți indică în orice mod că au pierdut interesul în urmărirea cererii. De asemenea, este important ca încercările noului reprezentant de a le contacta la adresele disponibile nu au fost de folos (a se vedea punctul 9 de mai sus). Prin urmare, Curtea concluzionează că acestea pot fi considerate ca fiind nu mai doresc să continue cererea (articolul (a) din Convenție). În plus, în conformitate cu articolul în amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererii.
Din aceste motive, Curtea, în unanimitate, decide să excludă aplicarea din lista sa de cazuri în conformitate cu art. 39 din Convenția în ceea ce privește 120 de solicitanți enumerați în apendicele A; Decide să scoată aplicarea din lista de cazuri în conformitate cu art. 37 din Convenție în ceea ce privește cele 53 de solicitanți listați în apendicele B. DECISION Application no. 20424/10 L. G. and Others against Hungary The European Court of Human Rights (Fourth Section), sitting on 4 September 2018 as a Committee composed of: Georges Ravarani, President, Marko Bošnjak, Péter Paczolay, judges, and Andrea Tamietti, Deputy Section Registrar, Having regard to the above application lodged on 22 March 2010, Having regard to the formal declarations accepting a friendly settlement of the case, Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The Hungarian Government (“the Government”) were represented by Mr Z. Tallódi, Agent of the Ministry of Justice.
The applicants complained under Article 11 of the Convention about the dispersal of their demonstration by the police.
The applicants were initially represented by Mr L. Grespik. On 4 May 2017, Mr T. Gaudi-Nagy, a lawyer practising in Budapest, informed the Court of the death of Mr Grespik and presented powers of attorney from two of the applicants.
On 2 June 2017 the Court invited the Government to submit observations on the admissibility and merits of the applicants’ complaint. By a letter dated 13 June 2017 Mr Gaudi-Nagy was informed of the communication of the case and invited to submit powers of attorney emanating from all the applicants.
On 6 April 2018, 120 of the 173 applicants submitted powers of attorney, authorising Mr Gaudi-Nagy to act on their behalf and represent them before the Court. The remaining fifty-three applicants did not submit any power of attorney for Mr Gaudi-Nagy or any other person. A. Friendly settlement reached in respect of 120 applicants
A list of the 120 applicants concerned is set out in Appendix A. 7 . On 16 May and 22 May 2018 the Court received friendly settlement declarations signed by 120 applicants and the Government under which the applicants agreed to waive any further claims against Hungary in respect of the facts giving rise to this application against an undertaking by the Government to pay them EUR 862 (eight hundred and sixty-two euros) each to cover any pecuniary and non-pecuniary damage as well as costs and expenses, which will be converted into the currency of the respondent State at the rate applicable on the date of payment, and will be free of any taxes that may be applicable. It will be payable within three months from the date of notification of the decision taken by the Court. In the event of failure to pay this sum within the said three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The payment will constitute the final resolution of the case. B. The remaining applicants
A list of the remaining fifty-three applicants is set in Appendix B. 9 . These applicants have not approached the Court since 21 March 2016, the date of the last letter from Mr Grespik. Following the death of their representative, these applicants did not submit a power of attorney authorising their representation before the Court. In addition, Mr Gaudi ‑ Nagy, the new representative of 120 applicants, informed the Court that he had tried to contact the remaining 53 applicants at the addresses registered with Mr Grespik and at those resulting from the official register. However, his attempts were unsuccessful. THE LAW
As regards the 120 applicants listed in Appendix A, the Court takes note of the friendly settlement reached between them and the Government (see paragraph 7 above). It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the application. This part of the application should therefore be struck out of the list of cases in accordance with Article 39 of the Convention.
As regards the remaining fifty-three applicants listed in Appendix B, their failure to keep the Court informed about a new representative or, indeed, to communicate with the Court or with the representative appointed by other applicants in any manner indicates that they have lost interest in pursuing the application. It is also of significance that the new representative’s attempts to contact them at the available addresses were of no avail (see paragraph 9 above). The Court therefore concludes that they may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases in accordance with Article 39 of the Convention as concerns the 120 applicants listed in Appendix A; Decides to strike the application out of its list of cases in accordance with Article 37 of the Convention as concerns the remaining 53 applicants listed in Appendix B.
