CASE OF LEDONNE AGAINST ITALY (No. 2) AND 161 OTHER CASES

Rezoluția CM/ResDH(2018)353 Execuția hotărârilor Curții Europene a Drepturilor Omului 162 de cazuri împotriva Italiei (Aprobată de Comitetul de Miniștri la 20 septembrie 2018 la ședința 1324 a Deputaților Miniștrilor) Comitetul de miniștri, în conformitate cu art. 32 anterior și cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale (denumită în continuare „Convenția”), având în vedere deciziile adoptate în temeiul articolului 32 din Convenție și hotărârile finale transmise de Curte comitetului în aceste cazuri și încălcările stabilite la art. 6 alineatul (1) din Convenție din cauza lungii excesive a procedurilor penale; Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat, dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilirea în integritate; și a măsurilor generale de prevenire a încălcărilor similare; după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior;

Având în vedere informațiile furnizate cu privire la plata satisfacției echitabile acordate de Curte sau de Comitetul [a se vedea documentul DH-DD(2018)700] Având în vedere faptul că măsurile individuale au fost, prin urmare, rezolvate, având în vedere faptul că s-au luat măsuri pentru accelerarea procedurilor care erau încă pendenti în momentul în care Comitetul a adoptat hotărârile în temeiul articolului 32 anterior sau a hotărârilor Curții Europene au devenit finale; Amintind că măsurile generale necesare în răspunsul la deficiențele constatate de Curte în prezenta hotărâre vor continua să fie examinate în cadrul cazului Ledonne (nr. 1) c. Italia , (Documentul nr. 35742/97) și faptul că închiderea cazurilor enumerate mai jos nu prejudecă în niciun caz evaluarea măsurilor generale în ceea ce privește durata excesivă a procedurilor penale; DECLARĂ faptul că a exercitat funcțiile sale în temeiul articolului 46 alineatul (2) din convenție în aceste cazuri în ceea ce privește măsurile individuale și DECIDE să încheie examinarea acestor cazuri.

Resolution CM/ResDH(2018)353 Execution of the judgments of the European Court of Human Rights 162 cases against Italy (Adopted by the Committee of Ministers on 20 September 2018 at the 1324 th meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of former Article 32 and those of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter “the Convention”), Having regard to its decisions adopted under former Article 32 of the Convention and to the final judgments transmitted by the Court to the Committee in these cases and the violations established of Article 6, paragraph 1, of the Convention on account of the excessive length of criminal proceedings; Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum; and - of general measures preventing similar violations;

Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having noted the information provided regarding the payment of the just satisfaction awarded by the Court or the Committee (see document DH-DD(2018)700 ); Considering that the individual measures have therefore been resolved, given that steps have been taken to accelerate the proceedings which were still pending at the time the Committee adopted its decisions under former Article 32 or the judgments of the European Court became final; Recalling that the general measures required in response to the shortcomings found by the Court in the present judgments will continue to be examined within the framework of the case of Ledonne (No. 1) v. Italy , (Application No. 35742/97) and that the closure of the cases listed below in no way prejudges the Committee’s evaluation of the general measures in relation to the excessive length of criminal proceedings; DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases as regards the individual measures and DECIDES to close the examination of these cases.
