CUARTA DECIZIE DECIZIE Nr. 60368/14 Săndel-Gabriel CIUPITU împotriva României și a altor 15 cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (a patra secțiune), care așezează la 17 decembrie 2020 în calitate de comitet compus din: Armen Harutyunyan, președinte, Jolien Schukking, Ana Maria Guerra Martins, judecători și Liv Tigerstedt, grefier adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, după ce a deliberat, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este stabilită în apendice. În temeiul articolului 3 din Convenție, reclamațiile reclamanților cu privire la condițiile inadecvate de detenție au fost comunicate guvernului român, care a prezentat observații cu privire la admisibilitatea și meritul.

Observațiile au fost transmise reclamanților, care au fost invitați să își prezinte propriile observații. Nu a fost primit niciun răspuns de către Curte. Prin scrisorile trimise de postul înregistrat, reclamanții au fost notificați că timpul permis pentru prezentarea observațiilor lor a expirat (a se vedea tabelul apendice pentru datele relevante). Reclamanții au atras în continuare atenția asupra articolului 37 alineatul (1) litera (a) din convenție, care prevede că Curtea poate elimina o cerere din lista sa de cazuri în cazul în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmărească cererea. Curtea nu a primit niciun răspuns la aceste scrisori (a se vedea detaliile din tabelul adăugat) și nu există scrisori anterioare din partea reclamanților care informează Curții cu privire la o schimbare de adresă.

HOTĂRÂREA având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Având în vedere cele de mai sus, Curtea concluzionează că reclamanții nu pot fi considerați ca fiind nu mai doresc să urmărească cererile (art. 37 § 1 litera (a) din Convenție). În plus, în conformitate cu art. 37 § 1 amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererilor. Având în vedere cele de mai sus, este oportun să se scoată din listă cazurile. Din aceste motive, Curtea decide, în unanimitate, să se alăture cererilor; pentru a elimina cererile din lista de cazuri.

DECISION Application no. 60368/14 Săndel-Gabriel CIUPITU against Romania and 15 other applications (see appended table) The European Court of Human Rights (Fourth Section), sitting on 17 December 2020 as a Committee composed of: Armen Harutyunyan, President, Jolien Schukking, Ana Maria Guerra Martins, judges, and Liv Tigerstedt, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix. The applicants’ complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government, who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations. No reply was received by the Court. By letters sent by registered post, the applicants were notified that the time allowed for the submission of their observations had expired (see the appended table for the relevant dates). The applicants’ attention was further drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

No reply to these letters has been received by the Court (see details in the appended table) and there are no previous letters from the applicants informing the Court about a change of address. THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the applications (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.

In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
