Cea decizia nr. 25397/20, Kenan BUČUK și alții împotriva Bosniei și Herțegovinei și a altor trei cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (a patra secțiunea), care așeză la 1 iulie 2021 în calitate de comitet compus din: Armen Harutyunyan, președinte, Jolien Schukking, Ana Maria Guerra Martins, judecători și Viktoriya Maradudina, grefier adjunct al secțiunii interioare, Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este stabilită în tabelul adăugat.
Reclamanții au fost reprezentați de dl O. Eterović, un avocat care practică la Sarajevo. La 5 noiembrie 2020, reclamațiile reclamanților în temeiul articolului 6 § 1 din Convenția și art. 1 din Protocolul nr. 1 privind neexecuția deciziilor interne au fost comunicate Guvernului Bosniei și Herțegovinei („Guvernului”). Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. În observațiile lor din 4 martie 2021, Guvernul a susținut că reclamanții nu au informat Curtea cu privire la faptul că hotărârile finale în favoarea lor au fost executate și au solicitat, prin urmare, Curtea să respingă cererile ca abuz al dreptului de cerere individuală în conformitate cu art. 35 §§ § 3 litera (a) și cu art. 4 din convenție.
Reclamanții nu au contestat faptele prezentate de Guvern. Curtea reiterează că o cerere poate fi respinsă ca abuz al dreptului de cerere individuală în sensul articolului 35 § 3 litera (a) din Convenție în cazul în care, printre altele, aceasta se bazează pe informații false sau în cazul în care informațiile și documentele semnificative au fost omitete în mod deliberat fie în cazul în care au fost cunoscute de la început, fie în cazul în care au avut loc noi evoluții semnificative în timpul procedurii. Informațiile incomplete și, prin urmare, înșelătoare pot constitui un abuz al dreptului la cerere, în special în cazul în care informațiile în cauză se referă la miezul situației și nu sunt furnizate explicații suficiente pentru faptul că nu se divulgă această informație (a se vedea Bruss v. Elveția [GC], nr. 67810/10, § 28, ECHR 2014; S.A.S.
v. France [GC], nr. 43835/11, § 67, ECHR 2014; și Čaluk și alții c. Bosnia și Herțegovina (dec.) [Comitetul], nr. 3927/15 și 63 altele, §§§ 18-19, 25 septembrie 2018). În ceea ce privește acest caz, Curtea observă că deciziile interne examinate au fost aplicate pe deplin în ceea ce privește unele dintre solicitanți înainte de notificarea cererilor au fost furnizate guvernului (a se vedea tabelul apendice). Reclamanții nu au informat Curtea cu privire la această dezvoltare. Curtea a aflat doar despre aceasta din observațiile Guvernului din 4 martie 2021. Nu a fost furnizată nici o explicație convingătoare pentru această omisiune. Având în vedere faptul că informațiile deținute se referă la esențialul cererilor, Curtea constată că această conduită a fost contrară scopului dreptului unei cereri individuale.
Avocații trebuie să înțeleagă că, având în vedere datoria Curții de a examina acuzațiile de încălcare a drepturilor omului, trebuie să prezinte un nivel ridicat de prudență profesională și o cooperare semnificativă cu Curtea, scutind-o de introducerea de plângeri nemeritorioase și, atât înainte de instituirea procedurilor, cât și ulterior, trebuie să cerceteze cu diligence toate detaliile cazului, să respecte cu atenție toate normele de procedură relevante și să îndemne clienții să facă același lucru.
În caz contrar, utilizarea abuzivă sau neglijentă a resurselor Curții poate submina credibilitatea lucrărilor avocaților în ochii Curții și chiar, dacă se întâmplă sistematic, poate duce la interzicerea în special avocaților individuali de a reprezenta reclamanții în temeiul articolului 36 § 4 litera (b) din Regulamentul Curții (a se vedea Stevančević c. Bosnia și Herțegovina (dec.), nr. 67618/09, § 29, 10 ianuarie 2017). Având în vedere cele de mai sus, Curtea consideră că prezentele cereri constituie un abuz al dreptului de cerere individuală în sensul articolului 35 § 3 litera (a) în amendă a Convenției. Prin urmare, acestea trebuie respinse în conformitate cu art. 35 § 4 din Convenție.

The list of applicants is set out in the appended table. The applicants were represented by Mr O. Eterović, a lawyer practising in Sarajevo. The applicants’ complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the non-enforcement of domestic decisions were communicated to the Government of Bosnia and Herzegovina (“the Government”) on 5 November 2020. THE LAW Joinder of the applications Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. Complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 (non-enforcement of domestic decisions) In their observations of 4 March 2021, the Government submitted that the applicants had failed to inform the Court of the fact that the final judgments in their favour had been enforced.
They therefore requested the Court to reject the applications as an abuse of the right of individual application in accordance with Article 35 §§ 3 (a) and 4 of the Convention. The applicants did not dispute the facts as presented by the Government. The Court reiterates that an application may be rejected as an abuse of the right of individual application within the meaning of Article 35 § 3 (a) of the Convention if, among other reasons, it was knowingly based on false information or if significant information and documents were deliberately omitted either where they were known from the outset or where new significant developments occurred during the proceedings.
Incomplete and therefore misleading information may amount to an abuse of the right of application, especially if the information in question concerns the very core of the case and no sufficient explanation is given for the failure to disclose that information (see Gross v. Switzerland [GC], no. 67810/10, § 28, ECHR 2014; S.A.S. v. France [GC], no. 43835/11, § 67, ECHR 2014; and Čaluk and Others v. Bosnia and Herzegovina (dec.) [Committee], nos. 3927/15 and 63 others, §§ 18-19, 25 September 2018). Turning to the present case, the Court observes that the domestic decisions under consideration were fully enforced in respect of some of the applicants before notice of the applications was given to the Government (see the appended table).
The applicants did not inform the Court about that development. The Court only learned about it from the Government’s observations of 4 March 2021. No convincing explanation for that omission was provided. Having regard to the fact that the information withheld concerned the very core of the applications, the Court finds that such conduct was contrary to the purpose of the right of individual application. Lawyers must understand that, having due regard to the Court’s duty to examine allegations of human rights violations, they must show a high level of professional prudence and meaningful cooperation with the Court by sparing it the introduction of unmeritorious complaints and, both before proceedings have been instituted and thereafter, they must inquire diligently into all the details of the case, meticulously abide by all the relevant rules of procedure and must urge their clients to do the same.
Otherwise, the wilful or negligent misuse of the Court’s resources may undermine the credibility of lawyers’ work in the eyes of the Court and even, if it occurs systematically, may result in particular individual lawyers being banned from representing applicants under Rule 36 § 4 (b) of the Rules of Court (see Stevančević v. Bosnia and Herzegovina (dec.), no. 67618/09, § 29, 10 January 2017). In the light of the foregoing, the Court considers that the present applications constitute an abuse of the right of individual application within the meaning of Article 35 § 3 (a) in fine of the Convention. They must therefore be rejected in accordance with Article 35 § 4 of the Convention. For these reasons, the Court, unanimously, Decides to join the applications; Declares the applications inadmissible.
