Rezoluția provizorie CM/ResDH(2025)264 Execuție a hotărârilor Curții Europene a Drepturilor Omului Grupul Gurban al cauzelor împotriva Turciei (Adoptat de Comitetul de Miniștri la 17 septembrie 2025 la ședința din 1537 a Deputaților Miniștrilor) Hotărârea de cerere a hotărârii finale la 4947/04 GURBAN 15/12/2015 15/03/2016 24069/03 ÖCALAN (N. 2) 18/03/2014 13/10/2014 27422/05 KAYTAN 15/09/2015 15/12/2015 33056/16 BOLTAn 12/02/2019 12/05/2019 Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”); având în vedere hotărârile finale transmise de Curte cu privire la încălcarea articolului 3 din Convenție din cauza încarcerării pe viață agravate a reclamanților - un termen de viață totală fără perspective de eliberare, reglementat de legislație care nu prevede un mecanism care să permită revizuirea sentinței după un anumit termen minim;
Amintind hotărârile anterioare ale Comitetului adoptate la 1419 și 1507 reuniunile în care măsurile individuale referitoare la încălcarea de mai sus sunt legate de punerea în aplicare a măsurilor generale care necesită adoptarea unui mecanism care să permită revizuirea oricărei condamnare agravată la viață după un anumit termen minim cu posibilitatea de eliberare, cu excepția cazului în care cerințele pedepsei și disuasiunii nu au fost încă îndeplinite în întregime sau persoana prezintă încă un pericol pentru societate; Amintind că art. 46 din convenție permite statului contestat să aleagă mijloacele prin care este în conformitate cu hotărârile Curții și că Curtea a remarcat că statele au o marjă de apreciere în materie de justiție penală și de condamnare, în timp ce, în același timp, dreptul internațional prezintă o tendință pentru mecanismele care furnizează o reexaminare cel târziu la 25 de ani de la impunerea condamnării pe viață; În plus, reamintind indiciile Curții că încălcarea constatată în cazurile prezente nu poate fi înțelesă ca fiind necesară ca reclamanții să aibă perspectiva de eliberare iminentă; subliniind obligația fiecărui stat, în conformitate cu dispozițiile articolului 46 alineatul (1) din Convenție, să respecte hotărârile finale ale Curții la care sunt părți, pe deplin, în mod eficient și prompt;
Interim Resolution CM/ResDH(2025)264 Execution of the judgments of the European Court of Human Rights Gurban group of cases against Turkey (Adopted by the Committee of Ministers on 17 September 2025 at the 1537 th meeting of the Ministers’ Deputies) Application Case Judgment of Final on 4947/04 GURBAN 15/12/2015 15/03/2016 24069/03 ÖCALAN (N o . 2) 18/03/2014 13/10/2014 27422/05 KAYTAN 15/09/2015 15/12/2015 33056/16 BOLTAn 12/02/2019 12/05/2019 The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”); Having regard to the final judgments transmitted by the Court concerning violation of Article 3 of the Convention on account of the applicants’ aggravated life imprisonment - an all-life term with no prospect of release, governed by legislation which does not provide a mechanism that would allow for review of the sentence after a certain minimum term;
Recalling the Committee’s previous decisions adopted at its 1419 th and 1507 th meetings that the individual measures relating to the above violation are linked to the implementation of general measures which require the adoption of a mechanism that would allow the review of any aggravated life sentence after a certain minimum term with a possibility of release, unless either the requirements of punishment and deterrence have not yet been entirely fulfilled or the person still poses a danger to society; Recalling that Article 46 of the Convention allows the respondent State to choose the means by which it complies with the Court’s judgments and that the Court has noted that States have a margin of appreciation in matters of criminal justice and sentencing, while at the same time, international law shows a trend for mechanisms providing a review no later than 25 years after imposition of life sentence; Further recalling the Court’s indications that the violation found in the present cases cannot be understood as requiring that the applicants be given the prospect of imminent release; Underlining the obligation of every State, under the terms of Article 46, paragraph 1, of the Convention to abide by the final judgments of the Court to which they are a party, fully, effectively and promptly;
EXPRESSED DEEP REGRET that the legislative or other adequate measures required to align Turkish law with the requirements of the Convention as spelled out in these judgments have not been adopted; EXHORTED the authorities to take the necessary measures without further delay; ENCOURAGED the authorities to consider exploring various alternatives at their disposal to ensure swift implementation of the judgments in the present group, including but not limited to introducing legislative amendments within the framework of the new Human Rights Action Plan providing for review mechanism for whole life sentences; making use of the “terror-free Türkiye” initiative and the recently established “National Solidarity, Brotherhood and Democracy Commission” which has the mandate to propose legislative amendments to Parliament; or adoption by Parliament of the draft bills on this issue that have already been introduced by members of Parliament; ENCOURAGED them once again to draw inspiration from the experience of other member States which have put in place such review mechanisms; INVITED the authorities to provide information on the measures taken to ensure swift progress in the implementation of the present group of cases, by the end of June 2026 at the latest.
