Gasimov împotriva Azerbaidjanului

Cererea nr. 82478/17 Sardar Gadir oglu GASIMOV împotriva Azerbaidjanului Curtea Europeană a Drepturilor Omului (prima secțiune), care a stat la 17 mai 2023 în calitate de comitet compus din: Alena Poláčková , Președintele Gilberto Felici , Raffaele Sabato , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 27 noiembrie 2017, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURA Dl Sardar Gasimov, reclamantul, s-a născut în 1957. Reclamantul a fost reprezentat de dl V. Mahmudov, un avocat cu sediul în Azerbaidjan. 13 din Convenția privind înghețarea conturilor sale bancare și lipsa unui remediu eficace în dreptul intern au fost comunicate părților.

Prin o scrisoare din 14 decembrie 2022, trimisă prin post înregistrat, reprezentantul reclamantului a fost solicitat să informeze Curtea cu privire la orice evoluție importantă a faptului, de la ultima sa corespondență cu Curtea. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Reprezentantul reclamantului a primit această scrisoare la 12 ianuarie 2023. Cu toate acestea, nu a urmat niciun răspuns. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii.

FACTS AND PROCEDURE

The applicant, Mr Sardar Gasimov, was born in 1957. The applicant was represented by Mr V. Mahmudov, a lawyer based in Azerbaijan. The applicant’s complaints under Article 1 of Protocol No. 1 to the Convention and Article 13 of the Convention concerning the freezing of his bank accounts and the lack of any effective remedy in domestic law were communicated to the parties. By a letter dated 14 December 2022, sent by registered post, the applicant’s representative was requested to inform the Court of any important factual developments since his last correspondence with the Court. His attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

The applicant’s representative received that letter on 12 January 2023. However, no response has followed. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
