FORTY-EIGHT CASES CONCERNING THE ADMINISTRATION'S DELAY IN PAYMENT OF ADDITIONAL COMPENSATION FOR EXPROPRIATION AGAINST TURKEY

Rezoluția CM/ResDH(2007)68 [1] Execuția hotărârilor Curții Europene a Drepturilor Omului în 48 de cazuri privind întârzierea în plată a unei compensații suplimentare pentru expropiere împotriva Turciei (a se vedea detaliile din apendicele) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumite în continuare „Convenția” și „Curtea”), având în vedere hotărârile transmise Comitetului de către Curte după ce au devenit definitive; reamintind că încălcarea Convenției constatate de Curte în aceste cazuri se referă la întârzieri în plata compensațiilor suplimentare pentru expropiere și la rata insuficientă a dobânzii nejustificate aplicabile (violația articolului 1 din Protocolul nr. 1); după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a se conforma obligației Turciei în temeiul articolului 46 alineatul (1) din convenție de a se conforma hotărârilor; după examinarea informațiilor furnizate de guvern în conformitate cu normele Comitetului pentru aplicarea articolului 46 alineatul (2) din convenție;

Având în vedere faptul că Statul pârât a plătit reclamanților satisfacțiile juste prevăzute în hotărârile (a se vedea detaliile din apendice), reamintind că constatarea încălcărilor de către Curte necesită, mai mult și mai mult decât plata satisfăcării juste acordate în hotărâri, adoptarea statului contestat, după caz, de - măsuri individuale pentru a pune capăt încălcărilor și șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilio în integritate; și - măsuri generale pentru prevenirea încălcărilor similare; după examinarea măsurilor luate de Statul pârât în acest sens; întrucât în timpul examinării cazurilor de către Comitetul de Miniștri, Guvernul Statului pârât a reamintit că deja au fost luate măsuri pentru a evita noi încălcări ale aceleiași tipuri (a se vedea Rezoluții ResDH(2001)70 și ResDH(2001)71 în cazurile Aka și, respectiv, Akkuș împotriva Turciei), în special prin intrarea în vigoare la 1 ianuarie 2000 din Legea nr. 4489, care a alăturat rata statutară a dobânzilor nejustificate cu rata anuală de reformulare aplicată de Banca Centrală Turcă la datoriile pe termen scurt (aceasta din urmă este stabilită și revizuită în mod permanent, ținând seama în special de rata inflației țării), și a indicat că hotărârile Curții au fost transmise autorităților în cauză;

DECLARA că a exercitat funcțiile sale în temeiul articolului 46 alineatul (2) din Convenție în aceste cazuri și DECIDE pentru a închide examinarea acestor cazuri.

Resolution CM/ResDH(2007)68 [1] Execution of the judgments of the European Court of Human Rights in 48 cases concerning the administration's delay in payment of additional compensation for expropriation against Turkey (see details in Appendix) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter referred to as “the Convention” and “the Court”), Having regard to the judgments transmitted to the Committee by the Court once they had become final; Recalling that the violation of the Convention found by the Court in these cases concerns delays in payment of additional compensation for expropriation and the insufficient rate of default interest applicable (violation of Article 1 of Protocol No. 1); Having invited the government of the respondent state to inform the Committee of the measures taken in order to comply with Turkey's obligation under Article 46, paragraph 1, of the Convention to abide by the judgments; Having examined the information provided by the government in accordance with the Committee's Rules for the application of Article 46, paragraph 2, of the Convention;

Having satisfied itself that the respondent state paid the applicants the just satisfactions provided in the judgments (see details in Appendix), Recalling that a finding of violations by the Court requires, over and above the payment of just satisfaction awarded in the judgments, the adoption by the respondent state, where appropriate, of - individual measures to put an end to the violations and erase their consequences so as to achieve as far as possible restitutio in integrum ; and - general measures preventing, similar violations; Having examined the measures taken by the respondent state to that effect; Whereas during the examination of the cases by the Committee of Ministers, the government of the respondent state recalled that measures had already been taken to avoid new violations of the same kind (see Resolutions ResDH(2001)70 and ResDH(2001)71 in the cases Aka and Akkuș against Turkey, respectively), in particular through the entry into force on 1 January 2000 of Law No. 4489, which brought the statutory rate of default interest into line with the annual rediscount rate applied by the Turkish Central Bank to short-term debts (the latter rate is fixed and permanently reviewed, taking into account particularly the country's inflation rate), and indicated that the Court's judgments had been sent out to the authorities directly concerned;

DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases and DECIDES to close the examination of these cases.
