Cerere anonimă

Identitatea reclamantului nu este divulgată în cererea depusă în fața Curții Europene:

inadmisibilă

În fapt:

Reclamantul a fost reținut pentru comiterea diferitor infracțiuni. Acesta a refuzat să se prezinte și a fost ținut în arest timp de 7 zile pentru stabilirea identității. Recursurile depuse de reclamant pentru contestarea privării sale de libertate au fost respinse. Ulterior, reclamantul a sesizat Curtea Europeană, invocând articolele 5, 6 și 14 din Convenție.

În drept

: Articolul 35 § 2 lit. a): Identitatea reclamantului nu a fost dezvăluită. Niciunul din formularele depuse Curții nu menționează numele său. Există numai o referință „Blondje alias NN cel 07 alias Nn.PI09.m.20081101.1100” și procura reprezentantului semnată „X”. Din cauza că dosarul nu conține niciun element care ar permite Curții identificarea reclamantului, cererea urmează a fi considerată anonimă.

Concluzie

: inadmisibilă (cerere anonimă).


