Rezoluția CM/ResDH(2011)159 [1] Execuția hotărârilor Curții Europene a Drepturilor Omului în 2 cazuri împotriva Spaniei (a se vedea apendicele) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”); având în vedere hotărârile finale transmise de Curtea la comitet; având în vedere faptul că a invitat guvernul statului interesat să informeze Comitetul cu privire la măsurile luate pentru a se conforma obligației sale în temeiul articolului 46 alineatul (1) din Convenția de a respecta hotărârile; având în vedere informațiile furnizate de guvern în conformitate cu normele Comitetului pentru aplicarea articolului 46 alineatul (2) din Convenția DCE; având în vedere în continuare că statul intimat a plătit reclamanții doar de hotări, DECLARES, având în vedere, Apendicele la Rezoluția CM/ResDH(2011)159 Informații privind hotărârile din 2 cazuri împotriva Cauzei Spaniei (depunere nr.) Execution of the judgments of the European Court of Human Rights

in 2 cases against Spain

(see Appendix)

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”);

Having regard to the final judgments transmitted by the Court to the Committee;

Having invited the government of the respondent state to inform the Committee of the measures taken to comply with its obligation under Article 46, paragraph 1, of the Convention to abide by the judgments;

Having examined the information provided by the government in accordance with the Committee’s Rules for the application of Article 46, paragraph 2, of the Convention;

Having further satisfied itself that the respondent state paid the applicants the just satisfaction provided in the judgments,

DECLARES, in the light of the above, that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases and

DECIDES to close the examination of these cases.
