Kosik și alte 4 cauze împotriva Ungariei

Rezoluția CM/ResDH(2012)36 [1] Execuția hotărârilor Curții Europene a Drepturilor Omului 5 cazuri împotriva Hotărârii Ungariei, cerere nr. Data deciziei Kosik, cererea nr. 48712/06 18/01/2011 László Balogh, cerere nr. 8183/07 15/06/2010 Názon, cerere nr. 23537/07 08/06/2010 Palotai, cerere nr. 44268/07 07/12/2010 Zichy Galéria (nr. 2), cerere nr. 920/07 08/06/2010 Comitetul miniștrilor, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase, astfel cum apar în deciziile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”); având în vedere că, în aceste cazuri, Curtea a luat notă oficială de soluționare prietenoasă atinsă de Guvernul Statului pârât și de reclamant, și a fost convinsă că decontarea s-a bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în Protocolul său, a hotărât, în unanimitate, să încheie aceste cazuri din listă; având în vedere că termenele de stabilizare prietenoasă au fost executate de statul pârât, DECLARES că a exercitat funcțiile sale în temeiul articolului 39 alineatul 4 din Convenția și DECIDES pentru a-și examinat.

Resolution CM/ResDH(2012)36 [1] Execution of the decisions of the European Court of Human Rights 5 cases against Hungary Case, Application No. Date of decision Kosik, application No. 48712/06 18/01/2011 László Balogh, application No. 8183/07 15/06/2010 Názon, application No. 23537/07 08/06/2010 Palotai, application No. 44268/07 07/12/2010 Zichy Galéria (No. 2), application No. 9200/07 08/06/2010 The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”); Considering that in these cases the Court, having taken formal note of friendly settlement reached by the government of the respondent state and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided, unanimously, to strike these cases out of its list; Having satisfied itself that the terms of the friendly-settlements were executed by the respondent State, DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and DECIDES to close their examination.
