BAJIC v. BOSNIA AND HERZEGOVINA AND OTHER APPLICATIONS

CUARTA DECIZIE DECIZIE Nr. 413/10 Boro BAJI de la Bosnia și Herțegovina și 35 alte cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (a patra secțiune), care așezează la 11 aprilie 2012 în calitate de comitet compus din: David Thór Björgvinsson, președinte, Nebojša Vučinić, Vincent A. De Gaetano, judecători și Fatoș Aracı, grefier adjunct al secțiunii, Având în vedere cererile depuse mai sus între 14 decembrie 2009 și 21 ianuarie 2011, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazurilor, după deliberare, hotărăsc după cum urmează: PROCEDURA Reclamanții sunt cetățeni ai Bosniei și Herțegovinei. Ele au fost reprezentate în fața Curții de către diferite avocați bosniaci.

Guvernul herzegovin („Guvernul”) a fost reprezentat de agentul lor, dna M. Mijić. Reclamanții s-au plâns în temeiul diferitelor articole din Convenția privind neexecuția hotărârilor interne finale rendue în favoarea lor împotriva Republicii Srpska pentru daune de război. Detaliile personale ale reclamanților și informațiile esențiale privind procedurile interne în ceea ce privește fiecare cerere sunt indicate în lista adăugată.

Între 15 septembrie 2011 și 2 februarie 2012, Curtea a primit declarații de soluționare prietenoase semnate de părțile în temeiul cărora reclamanții au convenit să renunțe la orice nouă reclamație împotriva Bosniei și Herțegovinei în ceea ce privește faptele care dau naștere la aceste cereri împotriva unei întreprinderi de a plăti ex grație de către Guvern 1000 de euro pe cerere pentru a acoperi orice prejudiciu moral, precum și costurile și cheltuielile, care ar fi convertite în mărci convertibile la rata aplicabilă la data plății, și ar fi eliberate de orice impozite care ar putea fi aplicabile. Acesta va fi plătit în termen de trei luni de la data notificării hotărârii luate de Curte în temeiul articolului 37 § 1 din Convenția Europeană pentru Drepturile Omului.

În cazul în care sumele nu au fost plătite în termenul de trei luni, guvernul s-a angajat să plătească dobânzi simple pe aceasta, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale. Părțile, de asemenea, au convenit că guvernul va asigura aplicarea deplină a hotărârilor interne luate în considerare în prezent în numerar în termen de nouă luni de la data notificării hotărârii luate de Curte în temeiul articolului 37 § 1 din Convenție. Aceste plăți ar constitui rezoluția finală a cazurilor. Curtea consideră că, în conformitate cu art. 42 alineatul (1) din Regulamentul Curții, cererile ar trebui să fie însoțite, având în vedere situația lor de fapt și juridică similară.

Curtea ia act de soluționarea prietenoasă achiziționată între părți și este convins că soluționarea se bazează pe respectarea drepturilor omului astfel cum este definită în Convenția și în Protocolurile sale și nu constată motive pentru a justifica examinarea continuă a cererilor (art. 37 § 1 în amendă a Convenției). Având în vedere cele de mai sus, este necesar să se scoată cazurile din listă. Din aceste motive, Curtea hotărăște în unanimitate să se alăture cererilor; hotărăște să scoată cererile din lista sa de cazuri.

DECISION Application no. 413/10 Boro BAJIĆ against Bosnia and Herzegovina and 35 other applications (see list appended) The European Court of Human Rights (Fourth Section), sitting on 11 April 2012 as a Committee composed of: David Thór Björgvinsson, President, Nebojša Vučinić, Vincent A. De Gaetano, judges, and Fatoș Aracı, Deputy Section Registrar, Having regard to the above applications lodged between 14 December 2009 and 21 January 2011, Having regard to the formal declarations accepting a friendly settlement of the cases, Having deliberated, decides as follows: PROCEDURE The applicants are citizens of Bosnia and Herzegovina. They were represented before the Court by different lawyers. The Bosnian ‑ Herzegovinian Government (“the Government”) were represented by their Agent, Ms M. Mijić.

The applicants complained under various Articles of the Convention of the non-enforcement of the final domestic judgements rendered in their favour against the Republika Srpska for war damage. The applicants’ personal details and the essential information as to the domestic proceedings in respect of each application are indicated in the list appended. Between 15 September 2011 and 2 February 2012 the Court received friendly settlement declarations signed by the parties under which the applicants agreed to waive any further claims against Bosnia and Herzegovina in respect of the facts giving rise to these applications against an undertaking by the Government to pay ex gratia 1,000 euros per application to cover any non-pecuniary damage as well as costs and expenses, which would be converted into convertible marks at the rate applicable on the date of payment, and would be free of any taxes that may be applicable.

It would be payable within three months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the European Convention on Human Rights. In the event of failure to pay the sums within the said three-month period, the Government undertook to pay simple interest on it, from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The parties, furthermore, agreed that the Government would secure full enforcement of the domestic judgments under consideration in the present cases in cash within nine months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the Convention.

These payments would constitute the final resolution of the cases. THE LAW The Court considers that, in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given their similar factual and legal background. The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications (Article 37 § 1 in fine of the Convention). In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court unanimously Decides to join the applications; Decides to strike the applications out of its list of cases.
