Data hotărârii JESIC (9336/08) 17/05/2011 MURATSPAHIC și alții (41925/06) 07/02/2012 Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor așezări prietenoase astfel cum apar în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”); având în vedere că în aceste cazuri Curtea, după ce a luat notă oficială de așezări prietenoase atinse de guvernul statului în cauză și de solicitanți, și după ce a fost satisfăcut că aședițiile s-au bazat pe respectarea drepturilor omului astfel cum au fost definite în Convenția sau în Protocolul său, a hotărât, în unanimitate, să scoată aceste cazuri din lista sa; având în vedere faptul că termenul încheiat de aședere așelte de statul său, DECLAR. The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”);

Considering that in these cases the Court, having taken formal note of friendly settlements reached by the government of the respondent State and the applicants, and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided, unanimously, to strike these cases out of its list;

Having satisfied itself that the terms of the friendly-settlements were executed by the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
