Zupančič și alții împotriva Sloveniei

A cincea secțiune DECIZIE Nr. 1110/07 Janko ZUPANČIČ și alții împotriva Sloveniei Curtea Europeană a Drepturilor Omului (a cincea secțiune), care a stat la 5 martie 2013 în calitate de comitet compus din: Ann Power-Forde, președinte, Boštjan M. Zupančič, Helena Jäderblom, judecători și Stephen Phillips, secretar adjunct al secțiunii, având în vedere cererea depusă la 20 decembrie 2006, Având în vedere retragerea cererii reclamanților, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE O listă a reclamanților este prezentată în apendice. Guvernul sloven („Guvernul”) a fost reprezentat de agentul lor. Reclamanții se plângeau în temeiul articolului 6 § 1 din Convenție cu privire la lungimea excesivă a procedurilor și în temeiul articolului 13 din Convenția cu privire la lipsa unui remediu intern eficace în acest sens.

După ce guvernul a primit notificarea cererii, ei au informat Curții că reclamanții au primit compensații în cadrul procedurii interne. Reclamanții au informat ulterior Curții că doresc să retragă cererea lor introdusă în fața Curții. Curtea ia act de faptul că această chestiune a fost rezolvată la nivel intern și că reclamanții doresc să își retragă cererea și că respectarea drepturilor omului astfel cum este definită în Convenția sau în Protocolurile sale nu necesită continuarea examinării cererii (art. 37 § 1 în amendă a Convenției). Având în vedere cele de mai sus, este necesar să se scoată cazul din listă în conformitate cu art. 37 § 1 litera (a) din Convenție. Din aceste motive, Curtea hotărăște în unanimitate să pună în aplicare cererea din lista cazurilor sale.

Zupančič, Helena Jäderblom, judges and Stephen Phillips, Deputy Section Registrar, Having regard to the above application lodged on 20 December 2006, Having regard to the applicants’ withdrawal of the application, Having deliberated, decides as follows:

FACTS AND PROCEDURE

A list of the applicants is set out in the appendix. The Slovenian Government (“the Government”) were represented by their Agent. The applicants complained under Article 6 § 1 of the Convention about the excessive length of proceedings and under Article 13 of the Convention about the lack of an effective domestic remedy in that regard. After the Government had been given notice of the application, they informed the Court that the applicants had received compensation in domestic proceedings. The applicants subsequently informed the Court that they wished to withdraw their application introduced before the Court. THE LAW The Court takes note that the matter has been resolved at the domestic level and that the applicants wish to withdraw their application.

It is satisfied that respect for human rights as defined in the Convention or its Protocols does not require the examination of the application to be continued (Article 37 § 1 in fine of the Convention). In view of the above, it is appropriate to strike the case out of the list in accordance with Article 37 § 1 (a) of the Convention.
