Rezoluția CM/ResDH(2013)123 Fábián și alții împotriva Ungariei Execuția hotărârii Curții Europene a Drepturilor Omului (Adoptat de Comitetul de Miniștri la 19 iunie 2013 la a 1174-a ședință a Deputaților Miniștrilor) (Cererea nr. 62440/12, hotărârea din 15 ianuarie 2013) Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase așa cum apar în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în acest caz, Curtea a luat notă oficială de soluționare prietenoasă atinsă de Guvernul Statului pârât și de reclamant, și având în vedere că decontarea s-a bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în Protocolul său, a hotărât să închidă acest caz din lista sa; având în vedere că termenele de soluționare prietenoasă au fost executate de Guvernul Statului pârât, DECLARES că a exercitat funcțiile sale în temeiul articolului 39 alineatul (4) din Convenția și DECIDES pentru a încheia examinarea sa.

Execution of decision of the European Court of Human Rights

(Adopted by the Committee of Ministers on 19 June 2013

at the 1174th meeting of the Ministers’ Deputies)

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
