CASE OF STOKES AGAINST THE UNITED KINGDOM

Rezoluția CM/ResDH(2013)213 Stokes împotriva Regatului Unit Execuția hotărârii Curții Europene a Drepturilor Omului (Cererea nr. 65819/10, hotărârea din 19/03/2013 (aprobată de Comitetul de Miniștri la 16 octombrie 2013 la cea de-a 1181-a ședință a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase așa cum apar în hotărârile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere că, în acest caz, Curtea, după ce a luat notă oficială de aranjamentul prietenos atins de guvernul statului reclamant și de reclamant, și după ce a fost satisfăcută că decontarea a fost bazată pe respectarea drepturilor omului, astfel cum este definită în art. 39, §4 al Convenției sale, și DECIDES, încheierea sa.

Execution of the decision of the European Court of Human Rights

(Application No. 65819/10, decision of 19/03/2013)

(Adopted by the Committee of Ministers on 16 October 2013

at the 1181st meeting of the Ministers’ Deputies)

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State;

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
