Rezoluția CM/ResDH(2015)56 Execuția hotărârii Curții Europene a Drepturilor Omului, Jean Larroche și Michel Larroche, împotriva Franței No. Cauza de la decizia 34309/13+ Jean LARROCHE și Michel LARROCHE 15/04/2014 (aprobată de Comitetul de Miniștri la 15 aprilie 2015 în cadrul celei de-a 1225-a ședințe a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere că, în acest caz, Curtea a luat notă oficială de soluționare prietenoasă, atinsă de guvernul statului respondent și de reclamant, și a fost satisfăcută că soluționarea s-a bazat pe respectarea drepturilor omului astfel cum este definită în convenția sau în protocolul său, a decis, în unanimitate, să ia acest caz de la lista sanctul DEC.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of friendly settlement reached by the government of the respondent state and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided, unanimously, to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State;

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
