Rezoluția CM/ResDH(2015)167 Execuția deciziei Curții Europene a Drepturilor Omului O.P. împotriva cererii Sloveniei nr. Cazul Data deciziei 19617/09 O.P. 06/01/2015 (Adoptat de Comitetul de Miniștri la 14 octombrie 2015 la a 1238-a ședință a Deputaților miniștri) Comitetul de Miniștri, în conformitate cu art. 39, §4 din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere că, în acest caz, Curtea, după ce a luat notă oficială de aranjamentul prietenos atins de guvernul statului reclamant și solicitant, și după ce a fost satisfăcută că decontarea a fost bazată pe respectarea drepturilor omului, astfel cum este definită în art. 39, alin. (4) din Convenția și DECIDES, pentru a-și încheia examenul.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
