Cazul de la decizia 23257/13 Georgios MEKRAS și Konstantinos KALOPAIDIS 13/01/2015 24305/11 Ilias THEODORATOS 17/02/2015 (Aprobat de Comitetul de Miniștri la 9 decembrie 2015 la 1243-a ședință a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase, așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea a luat notă oficială de soluțiile prietenoase achiziționate de Guvernul Statului pârât și de reclamanții lor, și a fost satisfăcută că aranjamentele se bazează pe baza drepturilor omului definit în Convenției sau în cadrul Convenției sale; având în vederea sarționamentul DLA.

(Adopted by the Committee of Ministers on 9 December 2015 at the 1243rd meeting of the Ministers’ Deputies)

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants, and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
