Cazul de decizie 11781/13 Klaus FUCHSHHUBER 23/06/2015 70899/10 Martine HRUBESCH 21/10/2014 (Adoptat de Comitetul de Miniștri la 24 februarie 2016 la ședința 1248 a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor așezări prietenoase în timp ce acestea au apărut în deciziile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea a luat notă oficială de aședirile prietenoase atinse de Guvernul Statului pârât și de reclamanții, și a fost satisfăcut că așaționată că aședițiile au fost bazate pe respectul drepturilor omului astfel cum au fost definite în Convenția sau în Protocolul său, DEC.

(Adopted by the Committee of Ministers on 24 February 2016 at the 1248th meeting of the Ministers’ Deputies)

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants, and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
