CUARTA DECIZIE DECIZIE Nr. 31059/14 Darie FARCAȘ împotriva României Curtea Europeană a Drepturilor Omului (Quarta Secțiunea), care așeză la 1 septembrie 2016 în calitate de comitet compus din: Vincent A. De Gaetano, președinte, Egidijus Kūris, Gabriele Kucsko-Stadlmayer, judecători și Hasan Bakırcı, secretar adjunct al secțiunii, având în vedere cererea depusă la 4 iunie 2014, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl. Darie Farcaș, s-a născut în 1973. Plângerile reclamantului în temeiul articolului 3 din Convenție privind condițiile de detenție inadecvate au fost comunicate guvernului român („Guvernul”), care a prezentat observații privind admisibilitatea și meritele.

Prin scrisoarea din 25 februarie 2016, trimisă prin post înregistrat, reclamantul a fost notificat că perioada autorizată pentru prezentarea informațiilor suplimentare a expirat la 21 decembrie 2015 și că nu a fost solicitată prelungirea termenului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Reclamantul a primit această scrisoare la 17 martie 2016. Cu toate acestea, nu a fost primit niciun răspuns. Având în vedere cele de mai sus, Curtea concluzionează că reclamantul nu poate fi considerat ca fiind nu mai doresc să urmărească cererea (articolul (a) din Convenție).

În plus, în conformitate cu articolul în amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererii. În consecință, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată aplicarea din lista cazurilor sale. FACTS AND PROCEDURE

The applicant, Mr Darie Farcaș, was born in 1973. The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”), who submitted observations on the admissibility and merits.. By letter dated 25 February 2016, sent by registered post, the applicant was notified that the period allowed for submission of further information had expired on 21 December 2015 and that no extension of time had been requested. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

The applicant received this letter on 17 March 2016. However, no response has been received. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
