SEGUNDA DECIZIE DECIZIE Nr. 10641/12 Inmane LEMGHARI și Fatima Zohra HAJJAJ împotriva Turciei Curții Europene a Drepturilor Omului (A doua secțiune), care așeză la 13 septembrie 2016 în calitate de comitet compus din: Nebojša Vučinić, președinte, Valeriu Grițco, Stéphanie Mourou-Vikström, judecători și Hasan Bakırcı, grefier adjunct al secțiunii; Având în vedere cererea depusă la 2 ianuarie 2012, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazului, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Reclamanții, dna Inmane Lemghari și dna Fatima Zohra Hajjaj, sunt resortisanți marocani, care s-au născut în 1987 și, respectiv, 1986 și trăiesc în Maroc.
Ele au fost reprezentate în fața Curții de către dl C. Yücel, un avocat practicant la Istanbul. Guvernul turc (“Guvernul”) au fost reprezentate de agentul lor. Reclamanții s-au plâns în temeiul articolelor 3 și 5 §§ 1 și 4 din Convenție cu privire la presupusele condiții de detenție slabe la Centrul de retragere a străinilor Kumkapı, la presupusa ilegalitate a detenției lor și la presupusa absență de remedii eficace pentru a contesta legalitatea detenției lor. La 26 aprilie 2016, Curtea a primit următoarele declarații semnate de Guvern: „Declar că Guvernul Turciei propune să plătească ex-gratie doamnei Inmane Lemghari, în vederea asigurării unei soluții prietenoase a cazului menționat mai sus, în funcție de Curtea Europeană a Drepturilor Omului, 11,000 EUR (even mii de euro) pentru a acoperi orice și toate prejudiciu material și moral, plus orice impozit care poate fi imputabil reclamantului.
Guvernul recunoaște că detenția reclamantului, condițiile de detenție la Centrul de retragere a străinilor Kumkapı, în cazul în care a fost deținută reclamantul, absența comunicării informațiilor reclamantului cu privire la motivele de detenție a acesteia, absența unor măsuri eficace de contestare a legalității detenției sale și solicitarea unei compensații constituie o încălcare a drepturilor reclamantului protejate de Convenția (a se vedea Abdolkhani și Karimnia c. Turcia , nr. 30471/08, 22 septembrie 2009, și Yarashonen c. Turcia , nr. 72710/11, 24 iunie 2014 … În cazul în care nu se plătește această sumă în termenul de trei luni, guvernul se angajează să plătească dobânzi simple pe aceasta, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale.

După consultarea reclamantului, vă informez că acceptă propunerea și renunță la orice alte afirmații împotriva Turciei în ceea ce privește faptele care dau naștere acestei cereri. Ea declară că acest lucru constituie o rezoluție finală a cazului.” „I, Cemal Yücel, remarcă că Guvernul Turciei sunt pregătite să plătească exgrația doamnei. Ea declară că acest lucru constituie o rezoluție finală a cazului.” Curtea ia act de soluționarea prietenoasă atinsă între părți. Este convins că soluționarea se bazează pe respectarea drepturilor omului astfel cum este definită în Convenția și în Protocolurile sale și nu găsește motive pentru a justifica o examinare continuă a cererii. Având în vedere cele de mai sus, este necesar să se scoată cazul din listă. Din aceste motive, Curtea, în unanimitate, decide pentru a elimina aplicarea din lista de cazuri în conformitate cu art. 39 din Convenție.

The applicants, Ms Inmane Lemghari and Ms Fatima Zohra Hajjaj, are Moroccan nationals, who were born in 1987 and 1986 respectively and live in Morocco. They were represented before the Court by Mr C. Yücel, a lawyer practising in Istanbul. The Turkish Government (“the Government”) were represented by their Agent. The applicants complained under Articles 3 and 5 §§ 1 and 4 of the Convention about the alleged poor conditions of detention at the Kumkapı Foreigners’ Removal Centre, the alleged unlawfulness of their detention and the alleged absence of effective remedies to challenge the lawfulness of their detention.
On 26 April 2016 the Court received the following declarations signed by the Government: “I declare that the Government of Turkey offer to pay ex gratia to Ms Inmane Lemghari, with a view to securing a friendly settlement of the above ‑ mentioned case pending before the European Court of Human Rights, EUR 11,000 (eleven thousand euros) to cover any and all pecuniary and non ‑ pecuniary damage, plus any tax that may be chargeable to the applicant.
The Government acknowledge that the detention of the applicant, the conditions of detention at the Kumkapı Foreigners’ Removal Centre where the applicant was held, the absence of communication of information to the applicant on the reasons for her detention, the absence of effective remedies to challenge the lawfulness of her detention and to request compensation amounted to a breach of the applicant’s rights protected by the Convention (see Abdolkhani and Karimnia v. Turkey , no. 30471/08, 22 September 2009, and Yarashonen v. Turkey , no. 72710/11, 24 June 2014). This sum will be converted into the local currency at the rate applicable on the date of payment, and will be payable within three months from the date of notification of the decision taken by the Court to strike the case out of its list of cases.
In the event of failure to pay this sum within the said three-month period, the Government undertake to pay simple interest on it, from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases in accordance with Article 39 of the Convention.
