Cauza de la Hotărârea 1838/08 Teimuraz ZHORZHOLIANI ȘI ALTE 28/06/2016 Comitetul de Miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor așezări prietenoase așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că în acest caz Curtea, după ce a luat notă oficială de aședința prietenoasă atinsă de guvernul statului informat și de solicitant, și după ce a fost satisfăcut că decontarea a fost bazată pe respectarea drepturilor omului astfel cum este definită în Convenția sau în Protocolul său, a hotărât să atace acest caz din lista sa; având în vedere că termenul de aședere prietenoasă a fost executat de guvernul statul ilicit, DECLARES că a exercitat în temeiul articolului 39 alineatul (4) al Convenției și DECIDES

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
