Hotărârea finală la 37087/97 BEKMEZC ȘI ALȚII 27/06/2002 Resoluție prietenoasă Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a drepturilor omului (denumită în continuare „Convenția” și „Curtea”), având în vedere hotărârea finală transmisă de Curte în acest caz Comitetului; având în vedere că, în acest caz, Curtea, având în vedere că a luat notă oficială de înțelegere prietenoasă a atinsă de guvernul statului în cauză și de reclamanții, și a fost satisfăcută că de înțelegerea s-a bazat pe respectarea drepturilor omului, astfel cum este definită la art. 46 alineatul (2) din Convenția în acest caz; având în vedere că, în acest caz, Tribunalul și DECIDES, s-au îndeplinit condițiile de încheiat.

Friendly settlement

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Having regard to the final judgment transmitted by the Court to the Committee in this case;

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicants, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case and

DECIDES to close the examination thereof.
