Hotărârea finală la 26308/95 INSTITUTUL PRIESTELOR FRANCEI ȘI ALȚII 14/12/2000 Resoluție prietenoasă Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere hotărârea finală transmisă de Curtea către comitet în acest caz; având în vedere că, în acest caz, Curtea, având în vedere că a luat notă oficială de soluționarea prietenoasă atinsă de Guvernul Statului pârât și de solicitanți, și fiind satisfăcut că decontarea s-a bazat pe respectarea drepturilor omului astfel cum este definită în Convenția sau în protocolul său, a decis să ia în considerare această listă de la art. 46 din Convenție; având în vedere că termenul său de la art. 46 DCE a fost executat comun de guvernul statul DH-DD (2017)534 ).

Friendly settlement

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Having regard to the final judgment transmitted by the Court to the Committee in this case;

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicants, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State (see document

DH-DD(2017)534

),

DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case and

DECIDES to close the examination thereof.
