Krylov și alții împotriva Rusiei

DECIZIA nr. 37448/09 Dmitriy Vadimovich KRYLOV împotriva Rusiei și a altor două cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A treia secțiune), care așezează la 17 aprilie 2018 în calitate de comitet compus din: Alena Poláčková, președinte, Dmitri Dedov, Jolien Schukking, judecători și Fatoș Aracı, grefier adjunct al secțiunii; Având în vedere cererile depuse mai sus la datele indicate în appenidix, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU O listă a reclamanților este prezentată în apendice. Matyushkin, reprezentantul Federației Ruse la Curtea Europeană a Drepturilor Omului, și apoi de succesorul său în acest birou, dl M. Galperin. Reclamanții nu au răspuns la scrisorile Curții, trimise prin poștă înregistrată, care le-a reamintit că termenele permise pentru prezentarea observațiilor lor în răspuns au expirat și că nu au fost solicitate prelungire a timpului.Atenția lor a fost atrasă la articolul (a) din Convenție.

Curtea consideră că reclamanții nu mai doresc să își urmărească cererile în sensul articolului (a) din Convenție. În plus, în conformitate cu articolul din amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului astfel cum este definită în Convenția și în Protocolurile sale care necesită examinarea continuă a cazurilor. Având în vedere cele de mai sus, este necesar să se scoată din listă cazurile. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; decide să se alăture cererilor din lista sa de cazuri.

DECISION Application no. 37448/09 Dmitriy Vadimovich KRYLOV against Russia and 2 other applications (see list appended) The European Court of Human Rights (Third Section), sitting on 17 April 2018 as a Committee composed of: Alena Poláčková, President, Dmitry Dedov, Jolien Schukking, judges, and Fatoș Aracı, Deputy Section Registrar, Having regard to the above applications lodged on the dates indicated in the appenidix, Having deliberated, decides as follows:

FACTS AND PROCEDURE

A list of the applicants is set out in the appendix. The applicants’ complaints were communicated to the Russian Government, who were represented initially by Mr G. Matyushkin, the Representative of the Russian Federation to the European Court of Human Rights, and then by his successor in that office, Mr M. Galperin. The applicants failed to respond to the Court’s letters, sent by registered mail, which reminded them that the periods allowed for submission of their observations in reply had expired and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention. THE LAW The Court considers that the applications should be joined and considered in a single decision.

The Court considers that the applicants may be regarded as no longer wishing to pursue their applications within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the cases. In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
