De Gaetano, președinte, Georges Ravarani, Marko Bošnjak, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 7 ianuarie 2014, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Reclamantul, dl Artur Toporkov, s-a născut în 1983. La momentul depunerii cererii în favoarea Curții, reclamațiile reclamantei în conformitate cu art. 3 din Convenție privind condițiile inadecvate de detenție au fost comunicate guvernului lituanian (“Guvernul”). Prin scrisoarea din 20 februarie 2018, trimisă prin post înregistrat la Facilitatea de Correcție din Alytus, reclamantul a fost informat că avizul unei părți din cererea sa a fost dat guvernului și că chestiunile în cauză fac obiectul unei jurisprudențe bine stabilite ale Curții. La 12 iunie 2018, Guvernul a informat Registrul că reclamantul a murit la 25 martie 2017. Potrivit documentelor oficiale prezentate de Guvern, el nu a fost căsătorit și nu a avut copii sau alți moștenitori înregistrați. Având în vedere cele de mai sus, Curtea concluzionează că reclamantul nu are moștenitori care ar putea fi considerați că doresc să urmărească cererea în sensul articolului (a) din Convenție. Prin urmare, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea decide, în unanimitate, să excludă aplicarea din lista de cauze. Having regard to the above application lodged on 7 January 2014,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Artur Toporkov, was born in 1983.
The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Lithuanian Government (“the Government”).
At the time of lodging his application before the Court (7
January 2014), the applicant was detained in Alytus Correctional Facility. By letter dated 20 February 2018, sent by registered post to Alytus Correctional Facility, the applicant was informed that notice of part of his application had been given to the Government and that the issues raised therein were the subject of well-established case-law of the Court. A friendly settlement declaration was proposed. No response to that letter was received by the Registry.
On 12 June 2018 the Government informed the Registry that the applicant had died on 25 March 2017. According to the official documents submitted by the Government, he had not been married and had had no children or other registered heirs.
In the light of the foregoing, the Court concludes that the applicant does not have heirs who may be regarded as wishing to pursue the application within the meaning of Article
37
§
1
(a) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
