DECIZIE Nr. 62856/10 Sergey Georgiyevich GRIGORYANTS împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 13 septembrie 2018 în calitate de comitet compus din: Alena Poláčková, Președintele, Dmitry Dedov, Jolien Schukking, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 22 octombrie 2010, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Reclamantul, dl Sergey Georgiyevich Grigoriants, s-a născut în 1953. Plainele reclamantului, în temeiul art. 6 § 1 din Convenție, privind absența sa la proceduri civile, au fost comunicate guvernului rus (“Guvernul”), care a prezentat observații privind admisibilitatea și meritul. Prin scrisoarea din 12 martie 2018, trimisă prin post înregistrat, reclamantul a fost notificat că perioada permisă de prezentare a observațiilor sale a expirat. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. În plus, în conformitate cu articolul din amenzi , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale care necesită examinarea continuă a cererii. Prin urmare, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide pentru a elimina cererea din lista de cazuri. Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Sergey Georgiyevich Grigoryants, was born in 1953.
The applicant’s complaints under Article 6 § 1 of the Convention concerning his absence from civil proceedings were communicated to the Russian Government (“the Government”), who submitted observations on the admissibility and merits.
By letter dated 12 March 2018, sent by registered post, the applicant was notified that the period allowed for submission of his comments had expired. The applicant’s attention was drawn to Article
37
§
1
(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. No response has been received.
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article
37
§
1
(a) of the Convention). Furthermore, in accordance with Article
37
§
1
in fine
, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
