Decizia nr. 2625/11 Anatoliy Nikolayevich LOSYUK împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 9 iulie 2020 în calitate de comitet compus din: Alena Poláčková, Președintele, Dmitry Dedov, Gilberto Felici, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 6 ianuarie 2011, După deliberare, decide după cum urmează: FACTE ȘI PROCEDURĂ Dl Anatoliy Nikolayevich Losyuk a fost născut în 1951. Reclamantul a fost reprezentat de dl Zavyalov, avocat practicant în Yessentuki. La 12 aprilie și 11 septembrie 2018, precum și la 30 aprilie și 30 aprilie 2018, reclamațiile reclamantului în temeiul articolului 6 § 1 din Convenție privind participarea unui procuror la proceduri civile au fost comunicate Guvernului rusesc („ Guvernului”), care a prezentat observații privind admisibilitatea și meritul. În septembrie 2019, Curtea a solicitat reprezentantului să prezinte informații suplimentare, inclusiv traducerea observațiilor reclamantului. (c) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că nu mai este justificat să continue examinarea cererii. Reprezentantul reclamantului a primit scrisorile; totuși, nu a urmat niciun răspuns. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (c) din Convenție, că nu mai este justificat continuarea examinării cererii. Din aceste motive, Curtea, în unanimitate, decide să excludă cererea din lista sa de cazuri. Efectuată în limba engleză și notificată în scris la 30 iulie 2020. FACTS AND PROCEDURE
The applicant, Mr Anatoliy Nikolayevich Losyuk, was born in 1951.
The applicant was represented by Mr Zavyalov, a lawyer practising in Yessentuki.
The applicant’s complaints under Article 6 § 1 of the Convention concerning the participation of a prosecutor in civil proceedings were communicated to the Russian Government (“the Government”), who submitted observations on the admissibility and merits.
On 12 April and 11 September 2018, as well as on 30 April and 30
September 2019 the Court requested the representative to submit additional information, including translation of the applicant’s observations. The applicant’s attention was drawn to Article
37
§
1
(c) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that it is no longer justified to continue the examination of the application.
The applicant’s representative received the letters; however, no reply has followed.
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article
37
§
1
(c) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
