Părțile reclamanților în temeiul articolului 2 din Convenție privind eficacitatea anchetei privind moartea rudei lor au fost comunicate guvernului turc („Guvernul”), care au fost reprezentate de agentul lor. Reclamanții nu au răspuns la scrisoarea Registrului din 14 iunie 2018 (recepută de reprezentantul lor la 25 iunie 2018), reamintind că perioada permisă pentru prezentarea observațiilor lor în răspuns a expirat la 23 aprilie 2018 și că nu s-a solicitat prelungire a timpului.

Curtea consideră că, în aceste circumstanțe, reclamanții pot fi considerați ca nu mai doresc să își urmărească cererea, în sensul articolului (a) din Convenție. , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cazului. Având în vedere cele de mai sus, este oportun să se scoată cazul din listă. Din aceste motive, Curtea decide, în unanimitate, să excludă cererea din lista de cazuri.

FACTS AND PROCEDURE

A list of the applicants is set out in the appendix. The applicants’ complaints under Article 2 of the Convention concerning the effectiveness of the investigation into the death of their relative were communicated to the Turkish Government (“the Government”), who were represented by their Agent. The applicants failed to respond to the Registry’s letter of 14 June 2018 (received by their representative on 25 June 2018), reminding them that the period allowed for submission of their observations in reply had expired on 23 April 2018 and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention. THE LAW The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention.

Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case. In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
