CUARTA DECIZIE A SECȚIEI Nr. 23359/06 Vasile BABU împotriva României Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 25 septembrie 2018 în calitate de comitet compus din: Paulo Pinto de Albuquerque, președinte, Egidijus Kūris, Iulia Motoc, judecători și Andrea Tamietti, grefierul adjunct al secțiunii, având în vedere cererea depusă la 31 mai 2006, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Vasile Babu a fost un național român care s-a născut în 1937. El a fost reprezentat în fața Curții de dl Popovici, avocat practicant la București. La 4 mai 2018, reprezentantul reclamantului a informat Registrul că reclamantul a murit și că moștenitorul său a exprimat dorința de a continua procedura. Prin scrisoarea din 18 mai 2018, Registrul a solicitat reprezentantului reclamantului întârziat o copie a certificatului de deces și a unui document care atestă capacitatea de a fi moștenitor al reclamantului întârziat. Această scrisoare a rămas fără răspuns. Iulie 2018 a fost trimisă din nou o scrisoare, prin corespondență înregistrată, reamintind reprezentantului reclamantului întârziat că perioada permisă pentru depunerea documentelor solicitate a expirat la 4 iunie 2018 și că nu a fost solicitată nicio prelungire a timpului. Această scrisoare, primită de reprezentantul reclamant întârziat la 31 iulie 2018, a rămas, de asemenea, fără răspuns. Reclamantul a murit și moștenitorul său poate fi considerat că nu mai dorește să își continue cererea în sensul articolului (a) din Convenție. În plus, Curtea nu constată motive privind respectarea drepturilor omului, astfel cum se definește la art. 37 § 1 în amendă, ceea ce ar necesita să continue examinarea cererii. Având în vedere cele de mai sus, este necesar să se scoată cazul din listă. Din aceste motive, Curtea, în unanimitate, decide să se scoată cererea din lista sa de cazuri. Having deliberated, decides as follows:
FACTS AND PROCEDURE

The applicant, Mr Vasile Babu, was a Romanian national, who was born in 1937. He was represented before the Court by Mr
D.
Popovici, a lawyer practising in Bucharest.

The applicant’s complaint under Article 1 of Protocol No. 1 to the Convention was communicated to the Romanian Government (“the Government”), who were represented by their Agent, Ms C. Brumar of the Ministry of Foreign Affairs.

On 4 May 2018 the applicant’s representative informed the Registry that the applicant had died and that his heir had expressed the wish to continue the proceedings.

By a letter of 18 May 2018 the Registry asked the late applicant’s representative for a copy of the death certificate and of a document attesting capacity as the late applicant’s heir. This letter remained unanswered.

On
18
July 2018 a letter was sent again, by registered mail, reminding the late applicant’s representative that the period allowed for submission of the requested documents had expired on 4 June 2018 and that no extension of time had been requested. This letter, which was received by the late applicant’s representative on 31 July 2018, also remained unanswered.

The applicant passed away and his heir may be regarded as no longer wishing to pursue his application within the meaning of Article
37
§
1
(a) of the Convention. Furthermore, the Court finds no reasons concerning respect for human rights, as defined in Article 37 § 1
in fine
, which would require to continue the examination of the application.

In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
