Lobanov împotriva Rusiei

Decizia nr. 52936/15 Aleksey Nikolayevich LOBANOV împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 15 noiembrie 2018 în calitate de comitet compus din: Alena Poláčková, Președintele, Dmitry Dedov, Jolien Schukking, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 15 octombrie 2015, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Reclamantul, dl Aleksey Nikolayevich Lobanov, s-a născut în 1984. Plențele reclamantului în temeiul articolelor 10 și 11 din Convenție privind arestarea și condamnarea sa a unei infracțiuni administrative pentru deținerea unei demonstrații individuale au fost comunicate guvernului rus (“Guvernul”).

La 1 septembrie 2018, reclamantul a informat Registrul că a vrut să retragă cererea la Curte. HOTĂRÂREA Având în vedere cele de mai sus și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea, în conformitate cu articolul (a) din Convenție, consideră că nu mai este justificat să continue examinarea cererii. Prin urmare, cazul ar trebui să fie exclus din listă. Din aceste motive, Curtea, în unanimitate, decide să ia cererea din lista cazurilor sale. FACTS AND PROCEDURE

The applicant, Mr Aleksey Nikolayevich Lobanov, was born in 1984. The applicant’s complaints under Articles 10 and 11 of the Convention concerning his arrest and conviction of an administrative offence for holding a solo demonstration were communicated to the Russian Government (“the Government”). On 1 September 2018 the applicant informed the Registry that he wanted to withdraw the application to the Court. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 6 December 2018. Liv Tigerstedt Alena Poláčková Acting Deputy Registrar President
