Mammadov împotriva Azerbaidjanului

A cincea secțiune DECIZIE nr. 8023/11 Elchin MAMMADOV împotriva Azerbaidjanului Curtea Europeană a Drepturilor Omului (A Cincea Secțiune), care așeză la 15 noiembrie 2018 în calitate de comitet compus din: Síofra O’Leary, președinte, Mārtiδš Mits, Lado Chanturia, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 21 ianuarie 2011, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Reclamantul, Elchin Mammadov, s-a născut în 1988. El a fost reprezentat în fața Curții de către dl Z. Mammadov, un avocat practicant în Azerbaidjan. Denumirea reclamantului, în fond, în conformitate cu art. 6 alineatul (3) litera (c) din Convenție privind lipsa asistenței juridice în etapele inițiale ale anchetei preliminare a fost comunicată guvernului azerigian („Guvernul”).

La 3 octombrie 2018, reclamantul a informat Registrul că a vrut să retragă cererea la Curte, deoarece nu mai este interesat să își continue cererea. HOTĂRÂREA Având în vedere cele de mai sus și în absența unor circumstanțe speciale referitoare la respectarea drepturilor garantate de Convenția și de protocolele în cauză, Curtea, în conformitate cu articolul (a) din Convenție, consideră că nu mai este justificat să continue examinarea cererii. Prin urmare, cazul ar trebui să fie exclus din listă. Din aceste motive, Curtea, în unanimitate, decide să ia cererea din lista cazurilor sale. FACTS AND PROCEDURE

The applicant, Elchin Mammadov, was born in 1988. He was represented before the Court by Mr Z. Mammadov, a lawyer practising in Azerbaijan. The applicant’s complaint, in substance, under Article 6 § 3 (c) of the Convention concerning lack of legal assistance at the initial stages of the pre-trial investigation was communicated to the Azerbaijani Government (“the Government”). On 3 October 2018 the applicant informed the Registry that he wanted to withdraw the application to the Court since he is no longer interested in pursuing his application. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 6 December 2018. Liv Tigerstedt Síofra O’Leary Acting Deputy Registrar President
