Korkotenkov împotriva Rusiei

Cererea nr. 71325/17 Vasiliy Pavlovich KORKOTENKOV împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 24 octombrie 2019 în calitate de comitet compus din: Alena Poláčková, Președintele, Dmitry Dedov, Gilberto Felici, judecători și Liv Tigerstedt, secretar interimar al secțiunii interioare, având în vedere cererea depusă la 7 septembrie 2017, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Reclamantul, dl Vasiliy Pavlovich Korkotenkov, s-a născut în 1983. Reclamantul a fost reprezentat de dl A. Vinogradov, avocat care practică în Kostroma. La 28 de ani, reclamațiile reclamantului în temeiul art. 3 din Convenția privind condițiile inadecvate de detenție au fost comunicate guvernului rus (“Guvernul”).

Martie 2018 reprezentantul reclamantului a informat Registrul că reclamantul a murit și că cererea sa la Curte nu va fi urmărită. Având în vedere cele de mai sus, deoarece niciun moștenitor nu a exprimat interesul de a urmări cazul și, în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenția, că nu mai este justificat continuarea examinării cererii. Prin urmare, acest caz ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE

The applicant, Mr Vasiliy Pavlovich Korkotenkov, was born in 1983. The applicant was represented by Mr A. Vinogradov, a lawyer practising in Kostroma. The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Russian Government (“the Government”). On 28 March 2018 the applicant’s representative informed the Registry that the applicant had died and that his application to the Court would not be pursued. The applicant did not have any heirs. THE LAW In the light of the foregoing, since no heir has expressed an interest to pursue the case, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 14 November 2019. Liv Tigerstedt Alena Poláčková Acting Deputy Registrar President
