CUARTA DECIZIE A SECȚIEI Nr. 57572/16 David FURUS împotriva României Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 15 octombrie 2020 în calitate de comitet compus din: Armen Harutyunyan, președinte, Jolien Schukking, Ana Maria Guerra Martins, judecători și Liv Tigerstedt, grefier interimar al secțiunii interioare, având în vedere cererea depusă la 19 octombrie 2016, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Reclamantul, dl David Furus, s-a născut în 1970. Plainele reclamantului în temeiul articolului 3 din Convenție privind condițiile inadecvate de detenție au fost comunicate Guvernului României („Guvernul”). La 29 ianuarie 2020, Guvernul a informat Registrul că reclamantul a murit.

La 25 iunie 2020, Registrul a trimis o scrisoare, prin post înregistrat, la adresa reclamantului întrebând dacă a existat vreun potențial moștenitor care dorește să persecute procedura în fața Curții. La 7 iulie 2020, soția reclamantului a semnat pentru primirea scrisorii înregistrate. Cu toate acestea, nu a fost primit niciun răspuns la această scrisoare. Având în vedere cele de mai sus, Curtea concluzionează că nu mai este justificat să continue examinarea cererii în sensul articolului 37 § 1 litera (c) din Convenție. Prin urmare, cazul ar trebui eliminat din listă. Din aceste motive, Curtea decide, în unanimitate, să excludă aplicarea din lista de cazuri. FACTS AND PROCEDURE

The applicant, Mr David Furus, was born in 1970. The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”). On 29 January 2020 the Government informed the Registry that the applicant had died. On 25 June 2020, the Registry sent a letter, by registered post, to the applicant’s address asking whether there was any potential heir wishing to pursue the proceedings before the Court. On 7 July 2020, the applicant’s wife signed for receipt of the registered letter. However, no reply to this letter has been received by the Court. THE LAW In the light of the foregoing, the Court concludes that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 5 November 2020. Liv Tigerstedt Armen Harutyunyan Acting Deputy Registrar President
