Rezoluția CM/ResDH(2020)238 Execuția hotărârilor Curții Europene a Drepturilor Omului Două cauze împotriva Belgiei (Aprobate de Comitetul de Miniștri la 3 decembrie 2020 la reuniunea 1390 a Deputaților Miniștrilor) Număr de cerere Cauza decizia 54634/18 Laeticia MIMBENGA 30/01/2020 12504/19 Gina NPONE 30/04/2020 Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase, astfel cum apar în hotărârile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”); Având în vedere faptul că în aceste cazuri, Curtea, după ce a luat notă oficială de soluționarea prietenoasă atinsă de Guvernul Statului pârât și de reclamanții, și având în vedere că soluțiile s-au bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în Protocolurile sale, a hotărât, în unanimitate, să atace aceste cazuri din lista sa; Având în vedere faptul că termenii acestor soluții prietenoase cu o întreprindere în ceea ce privește măsurile individuale au fost executate de Guvernul Statului pârât (a se vedea documentul DH-DD(2020)791-rev DECLARES că a exercitat funcțiile sale în temeiul articolului 39 alineatul (4) din Convenție și DECIDE pentru a încheia examinarea sa.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”);

Considering that in these cases, the Court, having taken formal note of the friendly settlement reached by the government of the respondent state and the applicants, and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided, unanimously, to strike these cases from its list;

Having satisfied itself that the terms of this friendly settlements with an undertaking in respect of individual measures were executed by the government of the respondent State (see document

);

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
