Ekinci și alții împotriva Turciei

Caz Data hotărârii 9879/10 Mehmet Mustafa EKİNC ȘI ALȚI 20/11/2018 Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase, astfel cum apar în hotărârile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), Având în vedere faptul că, în acest caz, Curtea, după ce a luat notă oficială de soluționarea prietenoasă atinsă de Guvernul Statului pârât și de reclamant, și având în vedere că soluționarea s-a bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în Protocolurile sale, a hotărât să atace acest caz din lista sa;

Având în vedere faptul că termenii de decontare prietenoasă privind plata sumelor convenite între părți au fost executați de Guvernul Statului pârât (a se vedea documentul DH-DD(2021)893 Având în vedere faptul că măsurile privind întreprinderea statului contestat de a se asigura că dreptul la viață – inclusiv obligația de a efectua investigații efective – continuă să fie examinate în viitor în cadrul grupului Kılavuz de cazuri (documentul nr. 8327/03), DECLARA că a exercitat funcțiile sale în temeiul articolului 39 alineatul (4) din Convenția și DECIDE pentru a încheia examinarea.

Resolution CM/ResDH(2021)274 Execution of the decision of the European Court of Human Rights Mehmet Mustafa Ekinci and Others against Turkey (Adopted by the Committee of Ministers on 20 October 2021 at the 1415 th meeting of the Ministers’ Deputies) Application No. Case Date of the decision 9879/10 Mehmet Mustafa EKİNCİ AND OTHERS 20/11/2018 The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”), Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list; Having satisfied itself that the terms of the friendly settlement concerning the payment of the sums agreed between the parties were executed by the government of the respondent State (see document DH-DD(2021)893 );

Having noted that the measures concerning the undertaking of the respondent State to ensure that the right to life – including the obligation to carry out effective investigations – is respected in the future, continues to be examined within the framework of the Kılavuz group of cases (Application No. 8327/03), DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and DECIDES to close its examination.
